    In the past two weeks, the political scene was dominated by two principal actors who played complementary roles in the nomination of candidates for political office.

    These are the various political parties that processed the nomination of their members, and the Independent Electoral and Boundaries Commission (IEBC).

    Both players fell way short of people’s expectations. They conspired and turned the nominations into a shameful charade. Whereas we all know these political parties are neither democratic nor well funded and, in some instances, privately owned – and Kenyans are too willing to excuse their failures – the calamitous performance by the IEBC was more profound.

    Kenyans have rarely been critical of the IEBC even when the commission would have benefited from some biting criticism. A number of factors inform this undeserved deference. First, because of the reconstruction of the commission and the process of its reconstitution, the commission is seen as an improvement on its predecessor.

    Second, Kenyans simply don’t want to think for a moment what would happen if the commission bungled the election as it happened in 2007. This is one commission that forced many Kenyans into silence using fear as immunity from public scrutiny.

    Third, the commission has successfully conducted the constitutional referendum and a number of by-elections.

    These positives have negative counterweights. First, the voter registration was the same as five years ago, showing a poor penetration. Second, voter education has never been more dismal. Third – and this is where all the problems emanate from – the commission is not very transparent when it comes to money matters. It has failed one test after another where procurement and financial probity are concerned.

    The issues of financial management have a profound bearing on electoral integrity. If the IEBC can’t pass the test of financial integrity, Kenyans shouldn’t expect it to pass electoral probity and integrity. The latest query it faces is the procurement of ballot papers which were described by a High Court judge as “indiscriminate and clandestine”.

    We all hear how this tender was single-sourced by one official and how many millions of dollars he was given. I don’t want to remind Kenyans how the biometric kit tender worth Sh3 billion ended up costing the taxpayer Sh8 billion, and how the difference was shared out. And we are silent on all these because of our fears.

    Coming back to the conduct of the IEBC on the nomination process, I saw danger signs of a systemic lack of integrity, disregard for the law, lack of political independence, pandering to politicians and outright corruption.

    This I observed first-hand as a lawyer who participated in the process. This is worrying in that, having seen how some of the commissioners cut corners with the law and integrity, what guarantees do we have that the same commissioners will not do the same on March 4?

    The IEBC deliberately turned a blind eye to the law. It refused to adhere to the law. For instance, candidates who did multiple defections were given nomination certificates contrary to the law.

    Candidates with multiple party certificates were cleared. Influential politicians were consulted in hotel rooms by members of the commission on how to rule on sensitive cases.

    Most alarming, and this out of my civic duty, I have shared my utter disbelief with the chairman of the commission on the conduct of a commissioner.

    This commissioner, using male relatives, was calling parties with cases before the commissioners and soliciting bribes. His modus operandi was to inform the victim that he already had an offer from the complainant and that he would rule in favour of the accused if the counter offer was better. Can we entrust such a commissioner with our fate on March 4? I have my fears.

    Prime Minister Raila Odinga has filed a fresh application seeking to compel the Independent Electoral and Boundaries Commission (IEBC) to allow a forensic audit of its IT system.

    Mr Odinga filed the application under certificate of urgency at the Supreme Court claiming the information contained in the electoral commission’s IT system will be crucial in the main petition he has filed challenging the declaration of Uhuru Kenyatta as winner of the March 4 presidential elections.

    To facilitate the forensic audit, he wants an order for the preservation of all Media Access Control (MAC) and Internet Protocol (IP) addresses for all mobile devices used for electronic voter identification at each of the 33,400 polling stations across the country.

    He also wants a preservation of all the Satellite Mobile Telephone handsets used for result transmission, all SIM Cards, laptops, desktop computers, and all the actual servers on which the electronic data transfer for the IEBC occurred.

    Mr Odinga further seeks an order for the IEBC to disclose confidentially to the Supreme Court a catalogue of the names of users and passwords assigned to each user at each of the IEBC offices, places of operation and each of the 33,400 polling stations.

    “The commission should also avail all receipts and invoices for each of the hardware or software materials they purchased to conduct electronic and manual transfer of results,” said Mr Oraro.

  7. It is with profound shock and great sadness that the Jubilee Coalition writes this formal protest letter to the Europe Union (EU). It has come to our attention that that two EU Core team observers (Naledi Lester and Mathieu Merino) are closely assisting the Coalition for Reforms and Democracy (CORD) in its spurious, mischievous and misguided Presidential Election Petition which seeks to overturn the will of the Kenyan People as expressed in what all observers have termed was a free, fair and credible election.

    This is simply unacceptable. For members of the observer group to adopt such a partisan role and openly assist a Candidate in the just concluded Presidential Elections makes a mockery of the EU’s claims of neutrality and non-partisanship. It is clear to all Kenyans that the EU had a vested interested in the Presidential Poll and all statements made and actions taken by the EU or its constituent States must be interpreted with that in mind.

    The refusal of the EU to abide by the basic standards of diplomatic courtesy has perplexed many Kenyans. However, in light of these recent developments it is now clear to us that the EU’s unprecedented action was a case of sour grapes over the defeat of their favoured Candidate.

    It had been alleged in various quarters that in the run-up to the General Elections the EU was covertly funding the Orange Democratic Movement (ODM) and CORD through funds laundered through Non-Governmental Organizations (NGOs) based in Kenya. At the time we viewed those claims as too incredulous to believe but now we regret to say that they have gained credence in our eyes.

    We wish to remind you that Kenya has been a steadfast friend and ally of Europe for many decades. To sully your reputation in the eyes of Kenyans over transient political alignments is not merely folly; it is an insult to the erstwhile close and enduring friendship that has existed all along between us.

    We DEMAND that the EU immediately cease its overt and active support for CORD and respect the sovereignty of the Republic of Kenya. The meddlesome attempts to load the die, in order to guarantee a favourable outcome for a Candidate perceived by the EU as more malleable and accommodating, is bound to fail. All that will be achieved is tarnishing the image and reputation of the EU in the eyes of Kenyans.

  9. Wow. just reading all the above comments is just amazing. Why promote tribalism and especially hatred? There are various/ almost all ethnic tribes represented in the new gov. But why the above comments?? and why does okoth allow it here??, I guess everyone has a right. BUT no one has a right to promote hatred/violence. The CJ stated that if anyone has a problem with the petition, please address it with the court. Am just saying..
