
Babito, A Kenyan mother who has been taking care of her two year-old baby, has been deported from Sweden, an act that has shocked members of the Kenya-Stockholm community who knew her. For a long time, Babito has been trying to acquire legal status in Sweden because of “family relationship” but unfortunately, the Swedish Immigration authorities have refused to accept her arguements.
Although her baby was born in Sweden, has a blond haired white Swedish father and a Swedish passport to boot, Babito was deported to Kenya following her arrest. KSB has been unable to establish whether she was deported alone or with her little baby. After her application for a Permanent Residence Permit was rejected, she filed an appeal which was also rejected last year, forcing her to go underground.
Immediately after she gave birth, the Kenyan woman was dumped by her Swedish partner who later told KSB on telephone that the separation was normal and that it had nothing to do with refusing to help Babito acquire a Residence Permit. At that time, concerns were raised by members of the Kenyan community when information spread that following the birth of her child, Babito had been abandoned by her partner without any means of livelihood.
According to the Swedish father, he had not abandoned his baby. The guy told KSB that he had done everything possible to help under the circumstances. Amid charges by some Kenyans that the man was evading responsibility, the man surfaced to say that he was in regular contact with Babito and that the two were working to resolve the crisis. That was two years ago.
The deportation of Babito is strange because according to the Swedish law, every child has a right of access to both parents regardless of marital circumstances. Assuming that Babito was deported together with her baby, the law is being violated because once in Kenya, the baby will cease to have contact with the father. If, on the other hand, the baby remained behind in Sweden, access to the mother will cease and this is contrary to Swedish law.
After Babito split with her Swedish man, she had no legal basis to stay in Sweden but once she gave birth, her new situation entitled her to stay on grounds of family reasons. Although the man dumped her after she gave birth, the separation is irrelevant from a legal point of view because the interest of the child which had come into being had taken precedence.
Mr. Robert Bekman, a refugee lawyer, told KSB that it is possible that the deportation is temporary and that Babito is likely to return to Sweden after six months or thereabout. According to the lawyer, a person in her situation can still be deported to fulfill the legal requirement that an application for a Swedish Residence Permit can only be made in one’s country of origin.
What this means is that Babito could still present a fresh application through the Swedish Embassy in Nairobi and await for a new decision.
The Lawyer told KSB that the requirement that an application be presented in one’s home country could, at times, lead to the element of the baby being overlooked depending on circumstances and especially if the father of the child is not supportive.
“These kinds of cases normally end up with the mother being allowed to stay because the child remains a Swedish citizen and it is only natural that the child has access to the mother”, Bekman told KSB. Babito’s former Swedish partner could not be reached for comment.

Då denna kvinna har ett barn som är fött i Sverige och därmed automatiskt är svensk medborgare, är det inte möjligt att skilja barnet från modern utan vidare. Bara skicka iväg modern går inte om det är för litet för det. Om barnet är större och det finns någon i Sverige så går det. Nu var ju barnet 2 år och då borde det gå med det sistnämda men å andra sidan så hade ju kvinnan ingen som hjälpte henne och hade inget ihop med mannen i fråga längre. Så detta med att mannen och kvinnan avslutatde sin relation kanske var en fint för att gå runt problemet. Om modern är ensam så blir det ju som sagt mycket svårt att skilja barn från modern och skall inte göras och torde strida mot en del lagar kanske? Detta då kvinnan är kenyansk medborgare och skall då ansöka från kenya, men barnet är svenskt automatiskt då det fötts i Sverige och då blir det knepigt då man inte skall separera dem. Så då borde det gått att ansöka om permanent uppehållstillstånd direkt i Sverige tycker man. Om jag vore kvinnan så skulle jag anmäla saken till europadomstol.

The last example applies both if you are a co-applicant to an employee, a self employed person or a student, and if you are the family member of a Swedish citizen or a permanent resident of Sweden.
It does not, however, apply if you are visiting Sweden on a visa or a temporary visitor’s permit. In such a case you may be granted an extension in the form of a temporary visitor’s permit, but not a residence permit for settlement.
Your permit must be valid when you submit your new application.
If you have or are expecting children in Sweden
If you are in Sweden without a valid residence permit you may in certain cases be granted a residence permit due to ties to a close family member, without having to leave Sweden. This applies if you have a child who has a residence permit or who is a Swedish citizen, and if you are expecting a child with a person who is a Swedish citizen or who has a permanent residence permit.
In these cases the requirements are:
•that you fulfill the conditions for being granted a residence permit due to ties to a close family member in Sweden
•that it is clear that you would have received a residence permit if you had submitted your application before coming to Sweden and
•it is not reasonable to demand that you return to your home country to apply.
The child’s best interest
The consequences for your child to be separated from his or her parent determins whether or not you can be granted a residence permit without having to leave Sweden.
Your application for a residence permit with in Sweden may be turned down if:
•you do not fulfill the requirements for a residence permit due to ties to a close relative
•it is likely that the embassy will be able to process your application within a reasonable period of time
•it is believed that your child will not be harmed by your temporary separation.
Your application may also be turned down if you have a criminal record or have been an illegal resident for a significant period of time, or if you have provided incorrect information.

Sven, the European Court will not help this woman because the Swedish Migration Board has clear rules about one who gets a child while living illegally in Sweden.
KSB documented another similar case affecting a Kenya-Stockholm woman in 2008. Also, the father of Babito’s child had stated that he had full love for the child, but wanted nothing to do with her. Without the support of her former boyfriend, she cannot be in Sweden. As for the child, he can come back after 18 years to meet the father. It could also be that Babito is just leaving Sweden temporarily to apply for a residence permit.

Jag antar givetvis att kvinnan skickades iväg med sitt barn.
Nu var ju barnet 2 år och då kanske det är en annan femma. Hade barnet varit mindre så kanske man kunda ha angett att barnet är för litet för att resa till ett annat land (annan bakterieflora osv)?
Kanske även om paret hade gift sig innan barnet föddes och kvinann hade lyckat få ett komplett personnummer (kan gå i bland)så kan hända att hon kunde ha fått stanna och ansöka här (inte på grund av att man gifter sig men på grund av personnummer)? Man förstår ju att migrationsverket har sina bestämmelser och att ett land måste ha vissa rutiner, men ibland känns det som om det inte finns någon smidighet.
Sven, this story is so mixed up you will never understand its head or tail. It has more problems to do with the mother’s relationship with her former boyfriend than what the Swedish law states in this case.
Babito’s intention was to exploit the former Swedish boyfriend by getting a child with him to live in Sweden. This is a nasty way of thinking because the sufferer is the child. When her former BF realized her moves, he simply cut her by not legally recognizing her as his partner. This was when the rain began beating Babito.Even though the father of the baby is Swedish, Babito has no right to be in Sweden because she had overstayed her visa period. If she was in good terms with the father of the child, then out of concern and humanity, he could have supported her to remain in Sweden.The problem is Babito is such a sly woman who is a parasite and lives by getting everything free of charge and thinks it’s her right.She left her Kenyan man in Kenya with her other baby and thought she could manipulate the Swede by applying Osewe’s Survival Manual tactics to remain here. This time she met her match and the Swedish man has dealt her a heavy blow.
Babito’s case is not different from that of a Kenyan woman documented at KSB in 2008 who was eventually divorced by the young Kenyan man she had manipulated to accept her child after she got impregnated by a Nigerian man. It is the same crude attitude of MTA DO? that was used to systematically confuse the young man regardless of his immediate family’s protests. He even went into the delivery room yet knew that was not his biological child. Some women come to Stockholm thinking they are smart-asses and can swing men anyhow. The Kenyan lady with the 2008 case is still hanging around even though she has nothing to do….a complete waste of her young age, in the name of living abroad. She is often seen at Kenyan parties keeping up appearances with an old pram that her now overgrown child still uses.
Good luck to Babito and hope she comes up with another type of scheming to survive. Getting a baby for papers doesn’t seem to be working.

Stackars Sven! Why don’t you marry the woman to keep her in Sweden? As mentioned by Sara and a few others, this particular case is complicated and the Migration Board is just following stated rules. Foreigners come to Sweden using different types of permits or visas. Babito came on a tourist visa which does not include overstaying and remaining an illegal alien. When she decided to get pregnant, it was solely for her to change her expired tourist status, by using the child whose father is a Swede, to live in Sweden. Now this was possible if the man loved her and was ready to tell the Migration Board (MB) that he will support her to live here. This was not the case with Babito who was rejected a long time ago by the former boyfriend. This automatically left her an illegal migrant and that is why despite appealing her case, she was rejected. The alternative would normally be for a man to support the woman and she can be requested by the MB to return to her country of origin, then come back with a new status, beginning with the first offer for a residence permit.
Sara was right that a child born by a foreign woman does not automatically give the mother permanent residency. The father is a Swedish citizen by birth, but the mother is an illegal alien. The child is automatically a Swede, but given that he is too young to remain with the father, he has the right to come back after he is 18 years, to look for his father. These are some of the consequences such women who get babies for papers do not think about. It is bitter, but if Babito messed up her former boyfriend, then he can challenge and get full custody of the child, but without her.

Although Babito has close ties with her son, the former boyfriend does not want her. This already tells you Sven, that she has nothing to use for bargaining in her case. Alternatively Sven, go to the Migration Board and help this woman.Go on a hunger strike by sleeping at the Central station with big placards bearing Babito’s photos and her son. You can then attract the Swedish media about her case. Maybe you can help her but later never complain if she does not thank you because that is the real Babito.

Historically there are precendents.Its not unusual to manipulate any system.What is most necessary is the instinct to be able to figure out your place in the whole situation.So lets not do the obvious by recommending remedies to an already existing path to a solution.Whatever was the said Babitos case ,it should become a forum to disparage her or any of other Kenyans ,who are facing the same set of complications.Its very psychologically damaging to those whose known problems are being bandied around by those who are not ready to reveal their identities so as to have meaningful and productive conversation about problems facing the communities where in we live.Let face problems with mature and sound ideas so as to solve not to decieve ourselves tha we are any better for making accusations.Its the greatest shortcoming of any a people to be not able to deconstruct their own civility.Some going ons in the communities in which we live in should be handled with utmost sincerity,otherwise we end up being fodder for the system.That all for the momment.

It was a matter of time before Babito’s manipulative character turned against her. There is a lot of good about her, but unfortunately this is clouded by a great will to exploit others for personal benefit. Her misfortunes in the past decade are a consequence of her dark side. She shouldn’t have forced her pregnancy for the sake of papers to live in Sweden. That Swedish dude was not just another use and dump kinda guy. wacheni zenu Babito is a sweet and loving person who cares for her child and friends.I know Babito from our days in Nairobi ghettos and i can’t remember that she was as evil as some write about her at KSB.she’s got many Kenyan lady friends in Stockholm who say she is very kind and nice to them.
KSB: Teddybear, I think that Babito is largely misunderstood. I talked to her and she sounded fairly reasonable, intelligent and upright. She may have her personal problems but it has to be appreciated that very few people are problem free. She is in a difficult situation and what she needs is help. I fixed a new lawyer for her and I think she will soon be fine with her baby.
