Makozewe: The current on going peace in Kenya is due to the current on going petition process by Cord. Those condemning Raila Odinga and his Cord coalition for filing a petition in the Supreme Court are insincere because the process is provided for in the Constitution. Regardless of preparations to portray the impression that all is well, much will depend on the type of case Cord presents in court to challenge the declaration of Uhuru Kenyatta as president-elect.
The denial of key documents to Cord’s legal team is not healthy. This is because documents related to elections held by IEBC should be public documents. By locking up the documents, IEBC is silently informing the watching public that it has something to hide. At this point in time, Cord requires all assistance it needs in the spirit of transparency and accountability. IEBC should therefore not hide documents or make it difficult for Cord to gather evidence. If Cord’s legal team is constantly frustrated, the outcome of the Petition in the Supreme Court will be in question especially in the eyes of the 5 million Kenyans who voted for Cord. This will be risky.
Let’s be realistic for once.. The cord coalition said they had strong evidence against IEBC .. What happened that they need more evidence???…Secondly do you expect the defendant to produce the evidence.. Let the cord coalition take the case to the Supreme Court n then the IEBC and safaricom shall defend themselves by producing the documents in court
I sympathize with RAO and CORD, they have been out-witted and out-maneuvered at every turn in this election. Even now, they are been manipulated like puppets and the last nail on their political coffin will certainly come a complete shock to many. To succeed in this election, two major components were required: full access to state resources and an enormous amount of votes. The first requires you to be either Head of State or affiliated with him, and the other requires a coalition of tribes with the numbers. RAO had none of these. His opponents had arrived at this conclusion too prior to the election and their strategies to beat CORD have been based on these two facts. It worked and is still working. Claims of rigging have been floated and may have merit, but who would believe these claims when you have the tyranny of tribal numbers against you? I will be a herculean task to prove that Jubilee had indeed fewer votes at this stage and the outcome I fear is another humiliating defeat for CORD. They had lost even before the elections began quite like the man that tries to catch a fish in water by out swimming it.
RAO should have begun working on his strategy for the 2013 election the day he made Prime Minister. Instead of relying on his tribal base to win him the prize, he should have pursued an aggressive political strategy that his opponents would have found difficult to counter. He should have cultivated an image of the protector of the down trodden Kenyan especially in urban areas, become the voice associated with NGO’s working to uplift Kenyans, given his office and himself the aura of a nationalist fighting the tribal ills of a polarized Kenya etc. He forgot that the events of post 2007 elections were a lesson to his opponents and only a fool would repeat the same mistake twice. The political elite currently in power are no fools, and he was effectively check-mated. What happened then so, as they say “so last year”. While RAO was immersed in enjoying the trappings of executive power and rewarding his kin and friends with lucrative positions, his opponents were busy sharpening their political blades. Now whenever he appears at a press conference, the crowd behind him and those protesting are predominately from his ethnic community. Who would want to associate with him when this has become his identity and being seen as what (Jomo) Kenyatta senior used to call “wasiotosheka”?
In the eyes of Kenyans and the International community, free and fair elections were held. The judiciary and executive are firmly in the hands of his opponents with ongoing preparations to inaugurate (Uhuru) Kenyatta Junior as the duly elected 4th President of Kenya. The peace was observed from all quarters and anything short of that at this juncture would be political suicide, any attempt to contravene what has happened with violence would result in RAO becoming a hunted fugitive like Uganda’s Kony. He has been effectively isolated and made impotent. Despite it all, it is business as usual once again.

This is surely becoming a comedy. CORD claimed election malpractices and they had concrete evidence to boot. Now it turns out that they are yet to gather evidence by seeking the High Court’s intervention in securing the evidence from Safaricom and IEBC, evidence that is now quite apparent they did not have to begin with. How do you file a petition without any evidence? This is a kitendawili of the confusing kind. What kind of people forge strategies for the CORD alliance? If these fellows cannot even muster enough evidence to present reasonable doubt in the IEBC election process, how would they then deal with the intrigues of governance if given power? This reveals to Kenyans the caliber of individuals in CORD, and it is really sad a politician of RAO’s caliber has surrounded himself with these people.
Kalonzo seems to have jumped ship already and has gone AWOL, he is conspicuously missing from the front-line at press briefings, most probably negotiating terms for himself with Jubilee like Mudavadi has done. Wiper as a party is finished and so are its officials. Their point man Kalonzo will turn his back on them quicker than you can say “jack rabbit”. He has done so before. I do sympathize with those who followed his lead because he is from their “people”. Many will go bankrupt or have incurred debts that will overwhelm them soon enough.
ODM officials will soon turn to each other, and tear each other apart as Kenyatta’s date with destiny at his inauguration approaches. Even miserable deadwood KANU fellows seem to have more political savvy than the bigwigs in ODM. There time in the spotlight is at an end and they were unfortunately too busy stroking their egos and banking their chests in arrogance to leave behind some resemblance of a legacy to be remembered for a selfless and well down job. Instead their names will always conjure up shame and ridicule associated with people maddened by the taste of power. Propagandists from the Diaspora, especially in Europe and The US, who had prophesied and propagated a CORD victory, seem to have slipped into melancholy in utter disbelief and despair. I suspect a few will succumb to alcoholism while in the process of deadening the pain and disappointment they have experienced. Those banking on a CORD win as a means of securing employment or promotion, are seemingly fated to advocating for political radicalism in obscure blogs to quench their now obviously misplaced sycophancy.

@Washa Fitina: Got the part about fighting for inclusion in the new Kenyan constitution. That is all well and dandy, but not an issue of contention in the current discussion. Many Kenyans fought, died and were maimed in the struggle for what passes as democracy in Kenya has today. It does not mean however that they are infallible or divine, remember even dictators like Kenyatta and Moi had their supporters too and they consider their rule as the best of times. Robotics should not be associated with behavioral traits but with science, hence the need to engage the process of reasoning. The rest of your comment is incoherent but if you were to rephrase in understandable English, then it is possible to get what you are trying to say.
