Fred Gumo is a very violent man who lost the Narc nomination polls for the Westlands seat in 2002 to Betty Tett, but was rigged in by the Narc Summit. He also “slapped a woman returning officer”. The guy will slap into line anybody who defies him. I kid you not when I say that the man is feared by many. Even president Kibaki was not able to cool him down when the man defied him by violently opposing a cabinet minister early in the Kibaki administration. And his consistent record of slapping people speaks for itself. This is a man who resolves problems by going violent and his antics are well known.
Once he walked into a bar off Tom Mboya street accompanied by a few of his cronies and on being presented with a bill, Hon Gumo was upset about something and he slapped the waiter and left the bar without paying for his drinks.
Then there was the 1997 election incident at the Railway Club where Fred Fidelis Gumo slapped a woman returning officer who had announced that he had lost the Westlands seat to Betty Tett. The frightened woman promptly reversed her announcement and declared Fred Gumo the winner of those controversial elections. Betty Tett filed an election petition which went absolutely nowhere just as the man with a rather big axe-shaped head had loudly announced to his supporters at Railway club while taunting them over the results that he had just influenced with his trade mark slap.

Minister Maitha has publicly said that he has handed the matter over to you. Kenyans expect that, this time round you will not treat them to your usual characteristic gentleman’s silence over thorny public issues and matters.
Your Excellency, I had more to write to you about my perception on how you are handling numerous issues of public interest but would rather do that after you dispose of the Gumogate Scandal. Your government and especially Your Excellency are indeed on test in this mega scandal.

Makali later identified one of his assailants as a man shown in press photographs engaged in beating the Reverend Timothy Njoya during a protest march on June 10, and asserted credibly that he is a member of the Jeshi la Mzee group of KANU Youth organized and employed by Fred Gumo of the Office of the President (see Section 2.a.). A woman who was raped and wrongly imprisoned due to police complicity is living under fear following threats by police officers.
Ms Monica Wanjiru, 31, was accosted by an officer from Langas Police Station who threatened her.
“He came to my home in Langas estate and slapped me twice in the face claiming that I had refused to pay rent yet it was a lie.
“He was alone and was not in uniform. I knew it was not about rent when he asked me where I thought my case would end up,” she tearfully told The Standard.
Wanjiru’s case file has since been recalled by the Director of Public Prosecutions Keriako Tobiko. This followed claims of a cover-up by police in a rape incident that led to the victim being locked up and charged instead of the culprits.
Wanjiru’s plight was highlighted by The Standard, including details of how police deliberately disowned her despite rescuing her after the rape. Police charged Wanjiru with giving false information, but Eldoret Resident Magistrate Innocent Maisiba ruled in her favour and set her free while admonishing police for “trying to cover up evil deeds”.

Wanjiru said following the incident, she had a friend lock her inside her house at night fearing that the officers would return to harm her.
“And true to my fears, they came back and when they found a padlock on my door, they thought I had fled. I could hear them saying I could run but one day they will find me and finish me,” she said.
The Centre for Human Rights and Democracy in Eldoret has condemned the action of the police officers. Wanjiru has reported the matter to the Eldoret Central Police Station where deputy OCPD Charles Mutua promised that action would be taken.
NANCY BARAZA will not go, however GEMA power AG will cut deal with her, and threaten her with 15yrs for illegeal gun possession. This will then enable her to SIDE and always make rulings with GEMA interestes.

Baraza gun probe is shoddy, says Tobiko

There isn’t enough evidence to prosecute Deputy Chief Justice Nancy Baraza on gun charges, Director of Public Prosecutions Keriako Tobiko has concluded.
The case put together by the police has gaps, inconsistencies and contradictions, says the DPP. He has now given the police seven days to fix them and report back to him. (READ: Police want Baraza tried)
“I have completed review of the file and sent it back to the police. In view of the evidence submitted by the police, we have found gaps, inconsistencies and contradictions to be addressed,” Mr Tobiko said.
Crucial witnesses had not recorded statements to corroborate claims against Lady Justice Baraza, he said. The country’s most senior lady judge is accused of assaulting Ms Rebecca Kerubo, a guard at Nairobi’s Village Market mall, and threatening to shoot her on New Year’s eve.
The Judicial Service Commission (JSC) has been investigating her conduct and will make its findings known on Friday.
Mr Tobiko said the CCTV footage, which formed a critical part of the evidence, required some explanation as it did not capture the alleged gun drama. It only shows Ms Baraza entering and leaving the pharmacy at the mall. (READ: Minister wants Baraza evidence made public)
“Why is this episode not covered in the footage? I want police to find out this from the Village Market management.”
Mr Tobiko also questioned the veracity of the confession by Ms Baraza, saying it raised several legal issues. Ms Baraza has since recanted the statement, claiming it was not taken according to the law.
“The statement may not be admissible in court. Accordingly, I have given the police commissioner seven days to address the critical issues raised and get back to us.”
Mr Tobiko said his decision had no bearing on the internal probe by the JSC.
“Our mandate is separate from JSC’s. The Judiciary is concerned with alleged professional misconduct, we are looking at criminality.
The burden and standard of proof is higher for us than the JSC. With the gaps and deficiencies raised above, I am not confident that if I charge the DCJ a conviction would result,” Mr Tobiko said
Focus now shifts to Chief Justice Willy Mutunga, who will receive the report of a team investigating the conduct of the judge and thereafter decide her fate.
Friday will be a day of big judicial decisions in other areas too — judges Isaac Lenaola, David Majanja and Mumbu Ngugi will be delivering the much-anticipated ruling on the election date.
At the Hague, International Criminal Court judges Ekaterina Trendafilova, Cuno Tarfusser and Hans Peter-Kaul will be returning from their Christmas vacation to announce the date for the ruling on whether six Kenyan suspects will stand trial for the post-election violence.

“He was alone and was not in uniform. I knew it was not about rent when he asked me where I thought my case would end up,” she tearfully told The Standard.
Wanjiru’s case file has since been recalled by the Director of Public Prosecutions Keriako Tobiko. This followed claims of a cover-up by police in a rape incident that led to the victim being locked up and charged instead of the culprits.
Wanjiru’s plight was highlighted by The Standard, including details of how police deliberately disowned her despite rescuing her after the rape. Police charged Wanjiru with giving false information, but Eldoret Resident Magistrate Innocent Maisiba ruled in her favour and set her free while admonishing police for “trying to cover up evil deeds”.

Wanjiru said following the incident, she had a friend lock her inside her house at night fearing that the officers would return to harm her.
“And true to my fears, they came back and when they found a padlock on my door, they thought I had fled. I could hear them saying I could run but one day they will find me and finish me,” she said.
The Centre for Human Rights and Democracy in Eldoret has condemned the action of the police officers. Wanjiru has reported the matter to the Eldoret Central Police Station where deputy OCPD Charles Mutua promised that action would be taken.

Baraza gun probe is shoddy, says Tobiko

There isn’t enough evidence to prosecute Deputy Chief Justice Nancy Baraza on gun charges, Director of Public Prosecutions Keriako Tobiko has concluded.
The case put together by the police has gaps, inconsistencies and contradictions, says the DPP. He has now given the police seven days to fix them and report back to him. (READ: Police want Baraza tried)
“I have completed review of the file and sent it back to the police. In view of the evidence submitted by the police, we have found gaps, inconsistencies and contradictions to be addressed,” Mr Tobiko said.
Crucial witnesses had not recorded statements to corroborate claims against Lady Justice Baraza, he said. The country’s most senior lady judge is accused of assaulting Ms Rebecca Kerubo, a guard at Nairobi’s Village Market mall, and threatening to shoot her on New Year’s eve.
The Judicial Service Commission (JSC) has been investigating her conduct and will make its findings known on Friday.
Mr Tobiko said the CCTV footage, which formed a critical part of the evidence, required some explanation as it did not capture the alleged gun drama. It only shows Ms Baraza entering and leaving the pharmacy at the mall. (READ: Minister wants Baraza evidence made public)
“Why is this episode not covered in the footage? I want police to find out this from the Village Market management.”
Mr Tobiko also questioned the veracity of the confession by Ms Baraza, saying it raised several legal issues. Ms Baraza has since recanted the statement, claiming it was not taken according to the law.
“The statement may not be admissible in court. Accordingly, I have given the police commissioner seven days to address the critical issues raised and get back to us.”
Mr Tobiko said his decision had no bearing on the internal probe by the JSC.
“Our mandate is separate from JSC’s. The Judiciary is concerned with alleged professional misconduct, we are looking at criminality.
The burden and standard of proof is higher for us than the JSC. With the gaps and deficiencies raised above, I am not confident that if I charge the DCJ a conviction would result,” Mr Tobiko said
Focus now shifts to Chief Justice Willy Mutunga, who will receive the report of a team investigating the conduct of the judge and thereafter decide her fate.
Friday will be a day of big judicial decisions in other areas too — judges Isaac Lenaola, David Majanja and Mumbu Ngugi will be delivering the much-anticipated ruling on the election date.
At the Hague, International Criminal Court judges Ekaterina Trendafilova, Cuno Tarfusser and Hans Peter-Kaul will be returning from their Christmas vacation to announce the date for the ruling on whether six Kenyan suspects will stand trial for the post-election violence.
