Judgment on the case in which a Kenyan man was charged with assaulting a Kenyan woman after a Kenyan Party in Sätra will be delivered in two weeks time. According to a KSB contact on the case, the Kenyan’s defence strategy was based on pleading for leniency on grounds that at the time he is alleged to have hit the woman, he was totally inebriated.
With the presence of a strong witness who was ready to stand beside the woman to support her case, police having been called to take statements and the woman’s injuries having been documented by Swedish doctors, the strategy of denying the assault may have been unworkable thus the Kenyans choice of taking the position that he couldn’t remember much of what happened on the material day.
The Kenyan was represented by his lawyer who questioned the women about their level of inebriation at the time of the alleged crime. Just like the Kenyan, the women admitted that they were not sober but this point may not play a very big role in the case because being inebriated is no excuse for going on attack.
The court noted that it is not the first time the Kenyan had been brought before the court system and this point may work against the him in the final analysis.
According to a lawyer familiar with such cases, the Kenyan may walk away with a fine of between 10-20,000 kr if he is lucky. If the court decides to take a harsher stand, he may be locked in for 6 months to two years depending on his past crimes and the severity of the crimes he may have committed in the past. The layer says that the Kenyan is likely to lose the case whichever way you look at it.
Some Kenyans were of the view that the case may have been settled out of court where the guy could part with a smaller amount of cash but the fundamental problem has been two-pronged – there has been no credible mediator while the assaulted woman has not been so keen on mediation.
KSB wishes to add that the two Kenyans have never had any romantic relationship before as alluded to in other discussion quarters. The brawl that may have led to the assault was a spontaneous event which happened in the twinkle of an eye and quite unexpectedly. The guy is known to be a cool guy and friends have not been able to understand how the assault may have happened. The woman has stuck to her guns that justice must be done.
