
The ODM Chairman of Nyamira county Mr. Stephen M. Nyakeriga has accepted that Mr. Robert Mosota Atei won the Magwagwa nomination for the post of Councellor on Thursday 17th January 2013. Mr. Nyakeriga, who bumped into Mr. Elisha Gisore (Mosota’s Chief Agent) at Orange House in Nairobi today, said that he was surprised that Mr. Mosota was not issued with the nomination Certificate. The ODM Chairman was present in the room when Mr. Mosota was declared the winner with 1,197 votes and expressed surprise at news that Mr. Mosota had not been issued with the Certificate.
Mr. Gisore informed the ODM Chairman that he was in Nairobi to hand over an Appeal letter to the ODM Election Tribunal since the matter could not be resolved at the County level where the fraud took place.
According to Mr. Mosota who spoke to KSB on telephone, the person who is personally responsible for the fraud is Mr. Elias Keton who refused to give him the Nomination Certificate at Nyamira County despite the fact that he (Mosota) had a hand written letter from Mr. Dickson Amaya, the Returning Officer at Ekerenyo, who declared him the winner of the nomination exercise.
Mr. Gesore told KSB that Mr. Nyakeriga requested for copies of the documents he wanted to hand over at ODM Headquarters at Orange House and he was given the documents. These included a copy of the Appeal letter signed by Mr. Mosota, a copy of election results at Magwagwa ward and a copy of the hand-written letter that was issued to Mr. Mosota by Returning Officer Amaya after Mosota won the nomination.
The fraud is different from other frauds that have hit the ODM Party nomination exercise because in the case of Mr. Mosota, there was no dispute at the polling station where the results were announced since the losers accepted defeat. No one understands why Mr. Keton refused to issue Mr. Mosota with the Nomination Certificate while no one knows who ordered him to sit on the Nomination Certificate and instead recommend Benta Nyaboke (who came second) as the winner.
There is a lot of concern in Magwagwa because Mr. Mosota’s supporters have declared that they will not accept a candidate imposed on them by crooks working against democracy at the ODM office in Nyamira. Mr. Nyakeriga promised Mr. Gisore that he would personally intervene on the matter and ensure that Mr. Mosota is the candidate who represents ODM at the County elections. “He said that he was unaware about what had transpired after Mr. Mosota had been declared the winner at Ekerenyo”, Mr. Gesore told KSB.
