Friday November 30, 2012 – Former Prime Minister Raila Odinga‘s coalition adviser Miguna Miguna on Thursday lost a Sh 6 million case where he had sued the government over non-payment of his salary arrears while he was working at the PM’s office.
In the case, Miguna wanted the court to order the government to pay him Sh6, 361,120 which he claimed was the three-year contract’s salary difference paid to former President Kibaki’s legal adviser Prof Kivutha Kibwana, who was performing the same role with him in the coalition government.
But High Court judge Lady Justice Hellen Wasilwa ruled that Mr Miguna was not discriminated against since he had initially obliged to the appointment letter given to him and continued to work in the capacity he was appointed to where he received salary and allowances.
The judge noted that if the former PM aide felt the terms and conditions befitting the office were not met, he should have turned down the appointment and sought appropriate terms to be addressed.
“Given that Mr Miguna continued serving and receiving salary and allowances, he cannot turn around and deny that he accepted the offer given to him and demand what was not in the appointment letter,” the Judge said.
Judge Wasilwa also noted that a letter from the former head of public service, Mr Francis Muthaura, had pointed out that Prof Kibwana’s salary was higher because he had more job experience than Miguna, having served as a Cabinet minister prior to his appointment as a Presidential adviser on legal matters.
Hej på dig och grattis.Lördag och snö här i Swedala och jag fixar med mina hästar som vanligt och hoppas på vinst. Ha så fint i England. Var i Wolverhampton och där var väl ungefär som du beskriver hur det är där du är. LITE FÖR LUNGT i bland.
Happy Birthday, enjoy & pls register as a voter either way!
