    If there was one thing that Jakoyo Midiwo achieved last Saturday with his pronouncement about the possible murder of Raila Odinga, he brought the entire nation to a standstill. The entire nation was stunned. Mourners too that had gathered at Dr. AL Gondi’s funeral looked bewildered. In fact their faces told it all.

    They were not sure whether to mourn Gondi or absorb the new threat to Raila Odinga’s life. Either way; whatever it is that made Jakoyo drop this bombshell at the funeral; it surely produced the desired results. He hit the entire nation with what would have been compared to a 15 kilogram bomb hurled at the crowd by an Al Shabbab suicide bomber.

    If indeed there is fire underneath the smoke that Jakoyo unleashed at Leah Gondi’s funeral, the police must wear their masks and dig deep under the smoke to put out the fire because if they don’t, that fire, lit by careless arsonists may consume us all including the arsonists.

    To analyze this story, let us start with the messenger of this bad news. Jakoyo Midiwo is no ordinary man. He is not insane, deranged nor does he court any signs of mental disorder. He is not some chang’aa drinking villager or some mad man at the marketplace prone to gatecrashing at village funerals and making outrageous statements in front of mourners. He is a respected member of parliament for Gem Constituency, a Chief Whip in Kenya’s parliament and a first cousin to Prime Minister Raila Odinga. In a nutshell, he is too responsible to utter carelessly matters as grave as the assassination of the Prime Minister of the Republic of Kenya.

    During his speech at the funeral, Jakoyo mentioned two crucial things: One, he chose to go public at that funeral because had he tried to confide in the intended target, he would have been dismissed casually. However, he conceded that he had discussed the matter with a cabinet minister and a permanent secretary known to be close the Prime Minister.
    He also said he was ready to swear by the bible and stand by his story. He was confirming that he had credible evidence to prove those allegations.

    With those two compelling statements, Midiwo threw the ball in the Police Commissioner’s court. The Commissioner must investigate the authenticity of the allegations and if found credible, charge the planners together with the assassins with attempted murder in a court of law. However, should the claims be proved false, Jakoyo and his informers must equally face the law.

    A possible assassination of a prominent political figure like Raila Odinga must shock and get all Kenyans who still harbor the theory of a united country really worried and depressed. Even if it is a rumour, it will trigger memories of Kenya’s dark past in the last 49 years beginning with Pio Gama Pinto’s assassination at his doorsteps in 1965.

    It will remind us of the demise of Argwings Kodhek on Kodhek Road in Hurlingham in what appeared like a road accident in January 1969,Tom Mboya’s assassination in broad daylight on Saturday July 5 1969 on Government Road in Nairobi just six months following Kodhek’s demise, the brutal murder of JM Kariuki whose mutilated body was discovered in Ngong Hills on March 5 1975 and another brutal murder of then foreign minister Robert Ouko in Got Alila near his Koru home in early 1990.

    If we look at these killings, each one of them had a political theory attached to it; something that folklore has never forgotten even if historians may never have documented them.

    Pio Gama Pinto died because he was believed to be Jaramogi Oginga Odinga’s foremost strategist and socialist ideologue. His elimination was believed to rob Jaramogi of a valuable ally in the post-independence struggle within the ruling party KANU. When Pinto was gunned down at his home just two years after independence, cracks had started to emerge in KANU between the socialists and capitalists. Jaramogi and Pinto preferred the former while Kenyatta and Mboya favoured the latter.

    Four years later, Mboya had to die in the same manner Pinto did despite the fact that he had led the onslaught against Jaramogi before and after leaving KANU to form KPU.

    It is instructive to note that Mboya, the only remaining prominent Luo in the Kenyatta cabinet was gunned down just six months before the 1969 elections which had been postponed from May 1968 to December 1969 for no apparent reason. He died because he was the most credible challenger to Kenyatta were the elections to be held in a fair, transparent and democratic manner. Planners of his death feared that should Kenyatta pass away suddenly, Tom Mboya would be unstoppable considering his unparalleled political campaign skills and popularity among Kenyans.

    The murder of JM Kariuki debunked the myth that Kenyatta’s regime was merely targeting non- Kikuyus. JM’s death brought the reality home that the regime Kenyatta led had taken a life of its own. This new class of Kenyans did not differentiate between their own and others as long as one interfered with their new found wealth and power.

    Kariuki had to die due to two things; he had become too popular with all Kenyans- being the only Kikuyu MP who travelled to Rusinga Island to bury Tom Mboya. More importantly he had become too vocal about the gap between the rich and the poor- often referring to Kenya as a nation of 11 millionaires against 11 million beggars. If Kariuki had challenged Kenyatta in the 1974 general elections, he would have won the elections by a landslide. He therefore had to die.

    Perhaps the most perplexing murder was that of John Robert Ouko who at the time of his death was Kenya’s foremost foreign minister. He died just weeks after defending Kenya’s human rights records at Stockholm and Oslo in what many Kenyan exiles in the Scandinavia thought were blatant untruths about the true picture of the regime in Nairobi.

    After his murder in Got Alila near his Koru home, theories abound about his closeness with Western powers that thought he would make a better president. It is these rumours that persisted so many years after his death.
    Again, just like Pinto, Mboya and JM Kariuki before him, Kenyans believed state operatives had a hand in his inhumane murder.

    Back to Midiwo’s allegations; who is bound to benefit from Raila Odinga’s death? Obviously what comes to mind are his foremost political opponents whether he dies a natural death or gets eliminated through an assassin’s bullet.

    Just like Mboya and JM Kariuki before him, he is currently the man to beat at the next elections if opinion polls are anything to go by. Secondly, the mere fact that almost all political heavy weights , the so called G7 have ganged up to stop his presidency is proof enough that he is the single most popular politician today. Therefore any misfortune or hand of God getting him out of the way will be a relief to his opponents despite the fact that they will shed a few crocodile tears soon after his death.

    Sam Ongeri is not running for president. He is therefore not a direct beneficiary of Raila’s death. If indeed he has anything to do with this heinious plan, it can only be on behalf of someone else? Does he have a motive, an axe to grind with the Prime Minister? I have no clue!

    Whereas its not my wish to absolve Mwau and Kabogo from money laundering allegations, I must tell you, PETER ODHIAMBO is not a clean man either.

    This former rugby player is a man who was previously employed by Barclays Bank in Kenya, until he masterminded fraud against Barclays in which the bank lost millions of shillings. During those days Odhiambo was a well known spendthrift in Nairobi’s entertainment joints. There are actually some congolese bands that composed songs in his honour as he was extremely generous with them. Yet he was a mere bank clerk whose lifestyle was a huge contrast to his actual and known income. Odhiambo used to change sports cars like you and I would change shirts.

    Odhiambo was summarily dismissed by Barclays in the 90s, arrested, tried in court and eventually convicted for a lengthy jail term. He served time in Kamiti only to be released through presidential clemency for ‘good behavior’. Odhiambo actually bribed his way to get his name recommended for early release.

    Upon release, he joined Chartethouse as a ‘consultant’ while its a fact that when he was dismissed by Barclays, he was by then a mere clerk. His joinig Charterhouse was motivated by the need to make quick money. It was not to be, and what you see in this wikileak report, was information which he used unsuccessfully to extort money from the wahindi owners of Charterhouse (same guys who own Kingsway tyres).

    You can see how the sly Odhiambo has used the same unveryfied infomation to win himself and his family US citizenship.

    That embassy officials opted to take Odhiambo’s whistleblowing as gospel truth, it begs the question if they bothered to do a background check on ‘Makuti Park – life member’ Odhiambo, or at least undertake a due delligence on charterhouse themselves directly.

    I urge you and jukwaa not to be taken for a ride by the likes of Odhiambo. Wikileaks is a big sham!

    Even previously convicted felons can still whistle-blow. If there’s a reward for the same, and their whistle-blowing turns out positive, they’re entitled to every penny promised. You’re thus deviating from the substantive matter into the world of ad hominems.

    You have a point regarding the general extortion culture prevailing in Kenya. But you must pin-point the extortion artists accurately. In this particular case, it is certainly not Peter Odhiambo. Odhiambo is merely demanding his rightful dues.

    Here was an auditor (Odhiambo) employed at Charter House Bank, who discovered that his employer (Charter House Bank owners – Harun Mwau et al) were essentially laundering money (to evade taxes) on behalf of companies like Nakumatt, Kingsway and others – some of which were incidentally also owned by the same Harun Mwau and the Shah family. It is now apparent that these unscrupulous businessmen figured out that setting up a bank (Charter House Bank) was the easiest way to hide and launder incoming cash and evade taxes.

    When Nakumatt collected their billions of shillings in sales, they deposited the cash into secret accounts within Charter House Bank – proceeds that were not reported as sales income – thus not surcharged taxes. These are the secretive accounts Peter Odhiambo’s watchful eye caught – and started surreptitiously documenting. We (public) were essentially being denied lots of billions of shillings in unpaid taxes.

    Odhiambo took his dossier to KRA – handing it to the Commissioner General Michael Waweru himself; Treasury (to Finance Minister David Mwiraria himself); and CBK (to CBK Governor Andrew Mulei himself) – on advise from lawyers who followed up from the background.

    Instead of getting his advertised rewards for whistle-blowing, he was met by death threats to himself and his family. His lawyers then advised him to seek protection from diplomats and the UNCHR; which he did. Of course, Odhiambo exchanged the high-value dossier with them; since many esp, the U.S. Embassy, were keenly interested in tracking down money laundering activities – avenues through which terrorist activities could be similarly funded unnoticed. We all know what the diplomats did with their information – some of which ended up in wikileaks…and where Odhiambo himself (& family) eventually landed.

    Who were the real extortionists in this case? All you need to do is simply follow-up what the government (specifically KRA Commissioner General, Finance Minister, & CBK Governor) did with Odhiambo’s dossier to know who the first batch of extortionists are.

    Apart from the then CBK Governor Andrew Mulei – the rest, from David Mwiraria (Treasury) and Michael Waweru (KRA) both decided to use the dossier as a milking (extortion) machine. Mulei did the right thing – launching a task force to investigate Charter House Bank. He was unceremoniously fired for that. On the contrary, Mwiraria and Waweru gleefully jumped into the scam. To hit the nail on the head, Mwiraria (Treasury) and Waweru (KRA) approached Charter House Bank and its clients like Nakumatt, Kingsway et al., with the dossier – to specifically extort from the respective owners. These companies owed us (the public) hundreds of billions of shillings in unpaid taxes; which they were not ready to submit but willing to bribe Mwiraria, Waweru etc to write them off.

    Mwiraria, Waweru (and very likely a proceed for their overall boss), each must have demanded a ‘cut’ of the unpaid taxes which were to be informally written off. To add insult to injury, the tax-evasion was to continue under ‘agreed’ terms. Thus, under a new equilibrium, the extortion and tax-evasion status quo prevails to date under fresh terms.

    In other words, since Odhiambo’s dossier, the “eating” from this tax-evasion scam was essentially transfered from the mid-level clerks and officers of government, to the top bosses – who were now eating directly. These top bosses of KRA, Treasury, and CBK (currently) are the first batch of extortionists.

    Every Finance Minister, KRA Commissioner, and CBK Governor since Mwiraria must have been involved in this on-going conspiracy. The tax evasion hasn’t stopped for sure. So count more beneficiaries of the scam to include Amos Kimunya, Uhuru Kenyatta, Njeru Githae, Njuguna Ndung’u, and John Njiriaini.

    Then comes the next batch of extortionists, masquearading as peoples’ watch-dog – in the formal name of the Chris Okemo-led Parliamentary Committee on Finance and Budgeting. After a “parliamentary inquiry” they found “no evidence” of money laundering, tax-evasion, or such vices and quickly wrote a report recommending the re-opening of Charter House Bank. That’s the face of extortion and evidence of bribery right there. Kenyans must stop being gullible and start understanding how they are being defrauded from all ends.

    That’s how Kenyans will also realize that another group of extortionists on daily high alert are media. Extortionist and super-bribed mainstream media has indeed skewed stories towards the direction of their palm-greasers. I bet many have read stories and editorials literally: demanding for the reopening of Charter House Bank; painting rosy pictures of the roles of KRA, Treasury and CBK on this matter; amplifying bogus parliamentary reports; or vilifying the likes of patriotic Kenyans like Andrew Mulei and Peter Odhiambo. Please don’t fall into the baits of these palm-greased salesmen of snake oil. Most of these writers are themselves extorting from the same tax-evaders.

    In short, rather than recover money for us (public), and reward Odhiambo for his whistle-blowing, all his cerebral effort ended up being the golden egg for the Mwirairas, Wawerus, Njiriainis, Ndungus, Kimunyas, Uhurus, Githaes, Okemos and other MPs of this world. In fact, his dossier ended up being the basis for the new partnership between the tax-evadors (Mwau and the Shah family) on one side; and the tax collectors & receivers (KRA, Treasury, CBK) on the other.

    What if Odhiambo decided to be an extortionist rather than a whistleblower? What if he just walked straight to Mwau and the Shahs directly, and demanded his ‘cut’? I guess he was smart enough to know he would have been dead by now, like the Goldenberg whistle-blower from Kajiado.

    I think Odhiambo still has some pretty good amount of functional cerebral matter above his shoulders. Does anyone see the significance of filing this case in the U.S. – just at a time when Uncle Sam has sanctioned Mwau’s businesses under the Drug Kingpin Act? Probably Mwau and others might this time want to negotiate with Odhiambo. Who knows?

  6. REVEALED: Names of who planned Raila’s assassination

    Tuesday the 17th of April 2012 – The twitter-verse is abuzz with the news that the individuals that ODM Chief Whip Jakoyo Midiwo named in the plot to kill Prime Minster Raila Odinga have been leaked.

    The Kenyan DAILY POST has no way of verifying whether these names are true but in the interest of informing its readership it shall publish the names as seen online;

    “William Ruto, Uhuru Kenyatta, Munyori Buku (Uhuru’s principal communications officer), Nick Wanjohi (former Vice Chancellor of JKUAT and Kibaki confidant), Nderitu Mureithi (MP Laikipia West) and chief of Kenya’s defense forces Gen Julius Waweru Karangi.”

    Midiwo allegedly revealed the names to the CID police officers when he visited their offices last week. The six individuals named above join Foreign Affairs Minister Sam Ongeri who was the first to be linked to the plot.

    The Gem MP made headlines during the Easter weekend when he suggested during a funeral attended by Raila that some powerful individuals were in government were plotting to assassinate the PM so as to remove him from the equation of those running for president.

    Joint Government Chief Whip Mr Jakoyo Midiwo relied heavily on unnamed sources and their verbal statements when he astonishingly announced a plot to kill Prime Minister Raila Odinga.

    Details of what Midiwo told police in regard to the alleged assassination plot are revealed today by The Standard.

    police ready to pounce on him after obtaining a warrant of arrest on Monday, and a possible libel suit by Foreign Affairs minister Prof Sam Ongeri in the wings.

    In his eight-page statement to police, Midiwo narrates how and where the alleged meetings to plan the assassination of Raila took place, and mentions those he claims attended.

    “I would like to state that sometimes (sic) during the month of March 2012, I was informed by a �citizen� whom I don�t want to disclose that there was a meeting taking place at the poolside of the Serena Hotel, Nairobi,” notes Midiwo.

    He says in the statement that he learnt of the plot through sources he has known for a long time, and trusts, but is unwilling to name.

    “I have known my sources for a long time and my view is that he is a very credible person,” says part of the signed statement, a copy of which The Standard has obtained.

    The Director of Public Prosecutions Mr Keriako Tobiko has also asked the police to arrest and charge the MP, who is still out of the country on official duty, for making false allegations in his statement.

    Secret meetings

    Midiwo sensationally mentions Deputy Prime Minister Uhuru Kenyatta, Finance minister Njeru Githae and his Foreign Affairs counterpart Prof Sam Ongeri as among individuals who attended part of meetings to allegedly plot the assassination. All have dismissed the claims as lies, while Prof Ongeri has instructed his lawyers to institute libel proceedings.

    Also mentioned as having attended the meetings is a very senior officer in the military, as well as Eldoret North MP William Ruto and a Mr Ndung�u.

    The first meeting, claims Midiwo, took place at the Serena Hotel�s poolside on March 6, while the second was at the private office in Gigiri, Nairobi belonging to the son of a leading Nyeri politician who, however, did not attend.

    Midiwo says the first meeting at the Serena Hotel, Nairobi was attended by Githae, Ongeri and Ruto and 10 other people whose identities his unnamed source was not familiar with.

    He adds that his source overheard part of the conversation, where Ongeri allegedly said that “at whatever costs Raila must not be allowed to become the President of Kenya”.

    The discussions, according to Midiwo�s statement, were conducted in English and that it is Ongeri who uttered the words.

    “Incidentally, my informer also told me that all the other participants agreed with Hon Ongeri that something must be done to Hon Raila,” adds the statement.

    He added another source informed him that Ongeri had asked his staff at the Foreign Affairs ministry how they would deal with international reaction in the event the PM was killed.

    Ongeri allegedly asked his staff to come up with an advisory paper, and later gave them a proposal after they slowed down in responding.

    Says Midiwo: Staff at the ministry allegedly sought clarification from the minister on what exactly would be their roles in the event Raila was assassinated.

    “In reply, Hon Ongeri categorically told his staff to give him a political answer since he was answerable to a boss who is a politician.”

    The statement says his source would not disclose the settings under which the minister�s instructions were being given, or if Ongeri was addressing one person or a meeting.

    The statement claims a second meeting on April 3 in Gigiri was attended by Uhuru, Githae, the top military official and a Mr Ndung�u.

    According to Midiwo his source informed him that those in attendance agreed to deal with Raila once and for all and have him eliminated.

    “I am not sure whether my source actually attended the meeting at… office. I was reliably informed that the meeting lasted up to about 2am and the subject matter was all about how to assassinate Hon Raila Odinga,” says Midiwo.

    He adds that he did not inform the PM before he made the allegations public, and demands that Uhuru clarifies a statement he made that Midiwo alleges referred to Raila as the only problem in Kenya.

    “Further, his statement that he has no problem with Luos except one of them needs to be clarified to the police,” says Midiwo.

    Mr Midiwo first made his claims at a funeral in Bondo on April 7, and asked Ongeri to clarify the role of alleged foreign mercenaries.

    Midiwo, however, exonerated President Kibaki and said he was not in the picture about the plot.

    Midiwo alleges that a meeting was held, which brought together two ministers, a senior security officer and a permanent secretary during which elimination of the PM was discussed as the last option in swinging the Kibaki succession race.

    He recorded a statement at the CID headquarters, Nairobi on April 10, on the basis of which detectives questioned those mentioned.

    In his statement, he also mentions the late Mary Onyango, the former vice-chair of the National Cohesion and Integration Commission (NCIC) as among those who had confided to him information on the plot.

    Uhuru aide

    He claims that Ms Onyango, who succumbed to cancer recently, told him on March 30 that a key aide of Uhuru threatened her through text messages accusing her of being used to destroy the DPM and said he would ensure she would disappear.

    “I advised her to report the matter to police, but unfortunately she collapsed and died the following morning.”

    Mr Tobiko has concurred with the police recommendations that Midiwo be arrested and be charged with the offence. Midiwo is out of the country and may be taken to court anytime in the week, police said on Monday.

    But the Gem MP told The Standard on the phone he is ready to go to court even as he insisted what he told police is true.

    Midiwo said witnesses had corroborated what he said and challenged police to make public the statements they recorded from all the persons he mentioned.

    The MP said police made the recommendations to charge him because he mentioned powerful individuals, some of whom he alleged are in high offices “naturally”.

    “It is a lie to them when some people who are untouchable are mentioned. I knew that will be their conclusion and I challenge them to make public all the statements that the people I mentioned submitted,” he said on phone.

    Midiwo said the work of the police is to confirm if information given to them is true or false. He added that police are being directed by some political class and demanded that the PM�s security be assured all the time.

    “I am ready to go to court and I will inform them when I arrive at the airport,” he added.

    Ongeri has denied the claims by Midiwo and demanded an apology from the MP.

    Looks like your grapevine source (of more than three-weeks) hit the nail on the head. What a styro of democracy! This rent-a-party and buy-a-party democracy is so outdated it doesn’t fool masses anymore. Thanks to a new Constitution and the Political Parties Act, Kenya will soon outgrow this era of briefcase parties, party-buying, party-hopping, and photo-ops with ethnic chieftains. That is so yesteryear.

    This move effectively disses Kiraitu Murungi’s mbas – will likely wound the latter’s ego going by expectations below:

    Uhuru’s handlers don’t seem to trust any politician – including Abdikadir and his UDF party. Not even Mwangi Kiunjuri’s GNU. Even Nginyo Kariuki had to be bought-out to avoid any possibility of clinging onto registration records. Thus, for Kshs 50 million, this is now personal froferty of Uhuru.
