President Obama’s nominee for the US ambassador post in Nairobi said that the United States will oppose Kenya’s request to the United Nations for a deferral of the cases against the suspected post-election violence sponsors.
Retired US Air Force Major General Scott Gration, President Obama’s pick to succeed Mr Michael Ranneberger, told a US Senate panel Tuesday that Kenya’s bid did not meet the conditions for a UN-sanctioned reprieve.
Because the US holds veto power on the Security Council, Gen Gration’s statement appears to signal doom for Kenya’s scheduled appeal to the council on Friday.
The country must persuade the 15-nation UN body that trials in the Hague would jeopardise international peace and security. But Gen Gration suggested on Tuesday that the opposite may be true. A UN deferral of the cases “may in some ways exacerbate the situation,” he said.
He did note that “other avenues” were open to Kenya in its quest for a deferral. Kenya can appeal directly to the International Criminal Court to allow the cases to be tried at home rather than in the Hague, he said.

Gen Gration’s comments reaffirmed the US position articulated earlier by Mr Ranneberger and senior State Department officials.
The nominee’s remarks on Tuesday on other Kenya-related topics also suggested he will carry on with the approach taken by Mr Ranneberger.

Alla sex ställdes i går och i torsdags inför domaren Ekaterina Trendafilova för att bli informerade om att de är misstänkta för brott mot mänskligheten, för att ha initierat mord, våldtäkter och folkfördrivningar.
1200 dödades och mer än en halv miljon kenyaner flydde sina hem efter valet i december 2007.
De sex hade kallats till Haag för att formellt informeras om misstankarna. Eventuella åtal följer senare, möjligtvis när de kallas åter till Haag i september.
I torsdags var det två ex-ministrar och en radiochef som ställdes inför domaren. I går var det Uhuru Kenyatta, som är både finansminister och vice premiärminister, samt presidentens högra hand och Kenyas förra polischef.
Domaren varnade Kenyatta och de andra att ICC kommer att utfärda en omedelbar arresteringsorder om någon av dem gör uppviglande uttalanden eller försöker skrämma vittnena.
Hon förklarade att man på ICC är orolig att kenyanska medier rör upp känslor så att våldet bryter upp igen.

De sex misstänkta finns på en lista med tolv namn som Kofi Annan överlämnade till domstolen i fjol. Kofi Annan hade kallats in som medlare i Kenya 2008 och lyckades till sist forma en koalitionsregering mellan ärkerivalerna presidenten Mwai Kibaki och oppositionsledaren Raila Odinga.
När Annan tröttnat på att vänta på att Kenya självt skulle utreda våldet lämnade han en lista med tolv namn till ICC. Av de sex hittills kända namnen som kallats till Haag hör tre till premiärminister Raila Odingas läger och tre till president Mwai Kibakis.
Mest känd är Uhuru Kenyatta, son till Kenyas landsfader och förste president Jomo Kenyatta. Andra är förre utbildningsministern William Ruto, förre industriministern Henry Kosgey och radiochefen Joshua arap Sang, som ledde en station i Rift Valley som piskade upp etniskt hat.
ICC har dessutom kallat in Francis Muthaura, sekreterare i presidentkansliet med ansvar för hela den offentliga sektorn, och Hussein Ali, som var Kenyas polischef.

Robbers reign terror on hospital staff where they molested drs&nurses on duty (raped&sodomised both male &female nurses)!
A member of staff was allegedly raped and several others injured in a shocking robbery incident at the Maragua district hospital in Murang’a County. The gang of seven robbers armed with AK-47 rifles raided the medical institution on Wednesday night and embarked on meting out terror on staff on duty while stealing anything they could lay their hands on. The hospital superintendent Dr Stephen Ngigi told the press that the robbers dressed in full police uniform disguised themselves as police officers who had taken a sick colleague to the hospital for treatment. The robbers tied up the two watchmen on duty with wires and commandeered them to where the medical staff on duty were. Dr Ngigi said the thugs visited every section at the hospital and rounded up the 12 medical personnel on duty plus the two watchmen into the maternity ward where they tied their hands and legs with wires and ordered them to lie on the floor. They stole money and other personal effects from the victims before raping a midwife as her colleagues and patients watched. They then broke into several offices including the administrator’s office where they vandalized equipment and ransacked desk drawers apparently looking for money before carrying away a computer monitor. The robbers seemingly not in a hurry then proceeded to the cash office where they stole the day’s collection of Ksh 43,000. Dr Ngigi said response by the police who used sniffer dogs to try and track down the thugs was rapid. Operations at the hospital, which is rated as one of the best managed in the country were grounded for the best part of Thursday morning with hundreds of stunned residents of Maragua town and its environs gathered at the institution. Dr Ngigi said the management had conducted a psychological debriefing of the victims whom he described as very distressed. He said that those injured had been treated for injuries sustained during the ordeal. Police detectives said they were piecing together evidence on the incident and were holding one person for questioning.

Education PS admits homosexuality rife in schools
Education Permanent Secretary Prof James ole Kiyiapi has admitted homosexuality is rampant in secondary schools.
He said just like the drug menace, homosexuality was real and a great threat to the future of the children.
Kiyiapi said the blame should be attributed to the leaders, parents and stakeholders in the education sector.
The PS, who was addressing journalists moments before presiding over a function at Ebenezer College in Kutus town, said children were victims of what the leaders say, and what they watch on television.
“Some of our leaders do not actually care what they say publicly while some parents just leave their children alone without providing them with the necessary parental guidance,” he said.
He said the influence of the Western culture and the behavior of some leaders and parents were the main causes of the social vice now being witnessed in schools.

Two Students Arrested for Molesting Form One Girl
Two students who inserted a metal bar into the private parts of a form one girl have been arrested. The Ngaru Girls Secondary School student is admitted at the Kerugoya District Hospital. School principal S.R Mbogo is also being held at the Kerugoya police station in relation to the incident. The 14-year-old said the two girls started molesting her when she resisted an attempt to be inducted into lesbianism. She reported the matter to the principal but he took no action.”After three weeks, the two girls cornered me and they pushed me to the ground and inserted a metal bar into my private part. One of them covered my mouth so I could not scream,” she said from her hospital bed. She reported the matter to the school deputy principal who forwarded her to the principal. On April 2, the principal, who was away at the time of the attack, refuted the claims saying that the girl was looking for an excuse to avoid sitting for her exams. On Tuesday, the girl’s father was called to school to collect her because she needed medical attention since she was urinating on herself uncontrollably. She was rushed to hospital and no explanation about the case was forthcoming. By yesterday, the girl was still waiting to be taken to theatre to have the metal bar removed. She said the principal visited her in hospital yesterday morning and warned her not to talk to anybody about the incident.”I have decided to talk due to the pain and suffering I have gone through,” she said. “I have to expose how innocent students are molested when they refuse to join lesbian groups in the school.” Nurse in-charge at the hospital Hannah Mburu said the girl is out of danger saying once the operation is done, she will recover fully.

focus must now shift to UHURU Kenyatta, the son of Kenyatta, our first President. Can this man make Kenya’s president in 2012? This is a question which we must pose, because of the activity this possibility has generated amongst the conservatives in GEMA and the Kalenjins. Political schemers in the PNU have suddenly seen a future in this guy. He has become the person who ‘MUST’ be president. He must not become president. He MUST. Notice the subtle difference. So the Government has purposed to make this PROJECT a SUCCESS. Even if it means spending public funds.
The political CALCULUS by the PNU strategists is to plant pons in the backyards of the other regions, including Balala in the COAST, Eugine in the WEST, Duale in the NORTH and Kalonzo in the MIDDLE EAST (Ukambani). We also have Mbuvi, Kiraitu, Musikari Kombo etc. Since the GEMA block is 80% assured, and the Kalenjins are under Rutos armpit, these guyz are banking on the pons to gather votes in the other regions and have an aggregate for Uhuru that is higher than any other opponents. Remember Uhuru is a government project. So a lot of resources shall be used for this, including the police, GSU, and if KIVUITU was there, and the old constitution, i would have been worried. For it would have been a SUCCESS, save for the possibility of post election violence. If you cannot see this simple plan, then go back to school.
Uhuru might not make it to the presidency in 2012 because of some realities in Kenyas political climate:-
Kenyans have had it with one region always producing the president. Kenyans yearn for a change of guard, ethnically speaking. Kenyans are saying: Let another tribe produce the CEO of the country. This will be his undoing. It will do him in.
Uhuru lacks the humility, maturity and romanticism needed when you are gearing up for presidency in Kenya. This may not bother the conservative GEMA, but it is hurting his ambitions in a big way.
Uhurus pedigree may not help. He is the son of a former President. In the US it would work, remember Bush senior and junior? In Kenya it would amount to enriching a certain political class
Uhuru has been surrounded by people known to Kenya as representing impunity, corruption, self interest and lack of any vision for the country. Eugine, Kombo, Sonko, Waititu, even Kiraitu..these guys are not helping much. Its further casts him as a warlord more than a presidential candidate.
The Hague is something he has to deal with. A lot of evidence may be made public and if Kenyans know what exactly happened, it will be too bad for him.
Uhuru might not get the support from the Kalenjin nation. Despite this being the thinking that the strategists have adopted, i can bet Kalenjins will not be comfortable voting for Uhuru.
Uhuru has not been very pro-reforms. He lacks any convincing reform credential.

Kenya: Statement on Judge Kaul’s dissenting opinion on post-election trials

The view that the post-election violence cases committed in Kenya do not fall under the jurisdiction of the International Criminal Court by Judge Hans-Peter Kaul’s has stirred excitement in certain circles. The judge’s position has been interpreted as a rejection of the trial of the six post-poll violence suspects at the Hague. At the very least the judge has not asserted that the six have no case to answer. The judge averred that there were indeed crimes committed under the jurisdiction of Kenya but they did not meet the traditional standards to warrant trial at the ICC. In his estimation, they are crimes that ought to be investigated and prosecuted locally.
Judge Kaul’s position is informed by the fact that for the crimes to have been committed, they should have been perpetrated as part of an organisational policy. The judge states that there was no such organisation during the post-election violence. The second limb of his dissent is that the crimes must have been committed in pursuance of a state policy.
Judge Kaul’s position constituted the minority view in the ruling by the Pre-Trial Chamber of the ICC; hence his ruling is only relevant in academic discourses on the question of jurisdiction of the ICC and the question of admissibility of cases before the court.
Kenyans must remember his emphasis that crimes were committed during the post-election violence period and those crimes should be tried. This underscores the need for a local mechanism to process those perpetrators that will not be tried at the ICC.
Although Justice Kaul insists that Kenya’s criminal justice system can investigate and prosecute the cases, TI-Kenya holds the view that any judicial mechanism used to deliver justice must be one that is credible and meets constitutional and international standards. The failure by the Kenyan Government to institute a local mechanism to try the post-election violence cases provided an opportunity for the ICC to take over the cases in the first instance. Kenya squarely met the ‘unable and unwilling’ requirements of the Rome Statute as three years since the post-election crisis no credible justice system has been established. Indeed Kenyans are not aware of any investigations carried out by our institutions on the violence thus far. The current justice system is yet to undergo reforms critical in addressing integrity and efficiency challenges that have long affected access to and delivery of justice in the country. Therefore it is imperative that concrete plans to address such challenges are put in place before any cases touching on the post-election violence are referred for local resolution.
TI-Kenya reaffirms its support for the trial of individuals who bear the greatest responsibility for the violence at the Hague and calls for speedy judicial reforms that will precede a local mechanism to try those not mentioned by the ICC Chief Prosecutor Luis Moreno Ocampo.

The Ministry of Internal Security has been directed to furnish Parliament with the names of suspected gold smugglers from DR Congo. The names of the suspects were given to President Kibaki when he met his Congolese counterpart Joseph Kabila.
Deputy Speaker Farah Maalim directed Internal Security assistant minister Orwa Ojode to supply the House with the details next Wednesday.
Also to be provided is a provisional report on the ongoing investigations on alleged smuggling of gold worth millions of shillings from the Democratic Republic of Congo into Kenya.
The directive was issued following a request by nominated MP Musa Sirma. The MP, seeking a ministerial statement, requested for all the names the Congolese President gave to Kibaki when he visited the country in March.
The MP also demanded that Parliament be given information on the investigations touching on the killing of Joseph Cheptarus — a senior Kenya Revenue Authority official who was leading investigation into the gold smuggling syndicate.
The KRA Assistant Commissioner for Investigations and Enforcement was probing the illegal importation of 2.5tonnes of gold from Eastern DRC. He was however shot four times at close range at his gate in South C in February.
The officer died while investigating the same smuggling and no action has been taken so far,” said Sirma. The MP also demanded to know why DCIO Lang’ata was transferred immediately after the death of the KRA officer.
Ojode had attempted to evade issuing the statement arguing that he delivered an answer in Parliament last week touching on the killing of the officer.
During his visit, Kabila met Kibaki in Nairobi where the two agreed to create a joint team to investigate alleged smuggling of gold from the DRC to Kenya.
