Ninakariri, ukombozi wa wengi utapatikana wakati tutakapotoka kwa ndoto na kurudi katika dunia halisi ya harakati za kitabaka na kujizatiti ipasavyo. Ndiyo, mwaka huu tutapata katiba mpya. Wacha ije. Lakini maisha mapya nchini bado yako mbali. Maana katiba mpya ndani ya mfumo wa ubepari haijaweza wala haitaweza kuleta maisha mapya kwa wengi. Katiba ya kibepari ilitimiza jukumu lake la kihistoria wakati ilipotumiwa kuondoa mfumo wa ukabaila na kuleta ule wa ubepari. Kutoka wakati huo katiba ya kibepari inalinda mfumo wa kibepari. Nimeisoma kwa makini ruwaza ya katiba mpya ya Kamati ya Nzamba Kitonga, ikisomwa kijuujuu inaonekana kuwa ya watu wote wa Kenya. Lakini ikichambuliwa kwa undani kutoka kwa msimamo wa kitabaka itadhihirika kuwa ya kulinda ubwanyenye kwa kupoza harakati za kitabaka. Wacha ije tuendendelee kujifunza na kukua.

Kote ulimwenguni, Kenya ikiwepo, dola la ubepari pamoja na katiba zake linaongozwa na mabepari, itikadi za kibepari na adili za kibepari.  Ni la kulinda mfumo wa ubepari. Nao mfumo wa ubepari ni wa kitabaka, wa unyonyaji wa mtu kwa mtu, wa mwenye nguvu mpishe mnyonge msonge. Mfumo wa vyama vingi, uchaguzi na utawala wa kidemokrasi ndani ya mfumo wa ubepari ni halali bora tu usilenge kuondoa mfumo wa ubepari. Dola za kibepari hutumiwa kuwanyonya na kuwanyanyasa wafanyikazi, wakulima makabwela na wale wote wasiyo na umilikaji wa viwanda, biashara kuu, mashamba makubwa na njia kuu za uzalishaji.

Ni la kuwatawala na kuwagandamiza wale wanaoishi kwa kutegemea ujira, wavujajasho, wakodeshaji nyumba, wale ambao ni mafukara ama walalahoi. Kwa ujanja wake, ambao ni pamoja na kujificha ndani ya katiba na demokrasi ya kibepari, dola la kibepari linaonekana kana kwamba liko kwa ajili ya taifa na kila raia pasina mapendeleo. Bali haijawezakana wala haitawezekana kuwa na usawa kati ya tajiri na maskini. Usawa huo unawezekana tu katika maandishi ya katiba wala siyo katika hali halisi ya maisha.

Kama kawaida ya katiba zote za kibepari, ruwaza ya katiba ya Kitonga imejaa orodha ya haki za binadamu, kama usawa katika sheria, uhuru wa kusema na kusambaza maoni, uhuru wa kutembea na kujumuika, haki ya matibabu, haki ya kujipatia riziki, haki ya kuwa na nyumba bora, haki ya elimu kwa kila raia, haki ya kuchagua au kuchaguliwa kiongozi, haki za wafanyikazi, haki za watoto, haki za wanawake, haki za walemavu na haki za wazee. Sawa, lakini wakati huohuo ruwaza ya katiba  inalinda mali ya binafsi ambayo ni msingi wa ubepari. Inaahidi haki na usawa kwa raia wote ndani ya mfumo wa kitabaka, jambo la kuwavisha vilemba vya ukoka wengi ambao ni mafukara na wanaolilia ukombozi.

Msingi wa katiba za kibepari ni kulinda na kuabudu haki ya mtaji na mali ya binafsi. Kwa mfano, mabepari wana haki ya kuwa na mali ya binafsi na kuikuza kwa vyovyote vile hata kwa kuwanyonya na kuwanyanyasa wafanyikazi katika viwanda, makarakana, makampuni, na popote pale penye mitaji yao. Nao mafukara eti wanahakikishiwa na katiba haki ya kuwa mabepari wakitaka. Lakini, utake usitake bila mtaji huwezi kuwa bepari. Huwezi kutoka kwa tabaka la wafanyikazi na kuingia tabaka la mabepari ghafla bin vu ati kwa kuwa tu umeamua kufanya hivyo au kwa sababu unaruhusiwa na katiba. Ukweli ni kuwa uwezo wa mtu kutoka tabaka la mafukara kuingia tabaka la mabepari ni sawa na ule wa ngamia kupitia tundu la sindano.

Tukiangazia Kenya tunaona kuwa jamaa za matajiri, zenye kudhibiti uchumi wa pesa, ardhi, biashara na mali tilatila, ni zilezile tu za kutoka kale na zamani. Aidha, pengo kati ya matajiri na maskini linazidi kupanuka nchini kila siku. Chimbuko cha umaskini si kuwa maskini hawafanyi kazi kwa bidii bali ni mfumo unaohakikisha kuwa kazi na bidii ya maskini inamfaidi tajiri badala ya yeye mwenyewe. Asili ya utajiri wa tajiri si kazi na bidii ya tajiri bali ni umilikaji wa njia ya uzalishaji inayomwezesha kuwanyonya wafanyikazi. Kujigamba kuwa umepanda kutoka biashara ya makaa na kuwa bilionea wa pesa, biashara, ardhi, majumba na mali tilatila leo kutokana na bidii zako binafsi, ni kutupigia hekaya za Abunwasi.

Ruwaza ya katiba mpya imewapa wananchi wote haki za matibabu. Lakini kadiri ambapo Kenya itandelea kuwa ya ubepari, matajiri ndiyo watakaondelea kutekeleza haki hii mara nyingi zaidi kuwaliko makabwela na mafukara. Nchini leo, udaktari, mahosipitali na matibabu ni biashara kama biashara yoyote ile inayowatajirisha watu binafsi kwa kuwanyonya wagonjwa. Bila pesa ni muhali kupata matibabu yoyote, sembuse matibabu bora. Adili za udaktari, ambazo ni pamoja na kujitahidi wakati wote kuokoa maisha, hazitekelezwi katika mfumo unaoongozwa na adili ya kuchuma mali kwa vyovyote vile. Wala hakuna huruma, pesa zimekuwa na thamani kuliko maisha Kenya. Udaktari kama utaalamu wowote ule unatumiwa kuendeleza mfumo wa unyonyaji wa mtu kwa mtu.

Elimu pia imekuwa bidhaa kama bidhaa yoyote ile. Wenye hela ndiyo wenye uwezo wa kuwanunulia watoto wao elimu bora zaidi katika shule za binafsi nchini na ughaibuni.  Elimu Kenya inatumiwa maksuudi kuzidisha na kuhifadhi utabaka na pengo kati ya matajiri na maskini. Na serikali haina haya wala aibu kuendeleza mfumo wa elimu unaowabagua, kuwakebehi na kuwanyanyasa watoto wa makabwela. Maana ni serikali ya mabepari.

Ndiyo, katiba mpaya ije. Bali tutumie muda wetu zaidi kuangazia mfumo wa kujamii – kiuchumi maana tusipoubadilisha na kuleta mpya na wa hali ya juu zaidi punde tutagundua kuwa katiba mpya vilevile ni mbio za sakafuni.

Penye moshi bila shaka hapakosi moto. Miaka aroboani na sita tangu tujinyakulie uhuru kutoka kwa ukolonimkongwe wa Wingereza dalili zinaonyesha kuwa umma umechoka na maisha chini ya mfumo wa ubepari. Na kama kuna pahali ukweli huu unajihidhirishia basi na katika Siku Kuu za Kitaifa, Madaraka Dei, Kenyatta Dei ambayo kwa kweli inafaa kuitwa Siku ya Mashujaa wa Kitaifa, na Jamhuri Dei. Pia na sherehe zingine za kitaifa kama Leba Dei.

Katika makumi ya sitini baada tu ya uhuru mnamo mwaka wa 1963, wananchi walikuwa wakimiminika kusherehekea Siku Kuu za Kitaifa kwa fahari, vifijo na nderemonderemo. Nyimbo ziliimbwa, ngoma zilicharazwa na kuchezwa, michezo mbalimbali iliburudisha, hotuba zilitolewa na viongozi kwa ufasaha na zikapokelewa na umma kwa mishangilio ya furaha na bashasha. Baadae karamu ziliandaliwa kila pahali. Almradi, Wakenya walikumbuka historia yao ya mapambano dhidi ya ubeberu huku wakiwa na matumaini makubwa kwamba maisha yao yangeliboreka, kama si wakati huo basi ni katika siku za usoni. Na kwa kweli katika kipindi cha miaka michache baada ya uhuru wananchi walishuhudia mipango mizuri yenye kuwahamasisha na kuwapa matumaini. Sera kabambe za kuimarisha uchumi wa kilimo, biashara na viwanda na za kuleta ajira kwa wengi zilitekelezwa. Huduma za jamii kama elimu, matibabu, nyumba na burudani zilionekana zikikua sehemu nyingi nchini, mijini na mashmbani.

Lakini kumbe mgema akisifiwa pombe hulitia maji, sera za kimaendeleo hazikudumu muda mrefu. Siasa za hiana na ulafi zilitibua mambo na kufanya matumaini ya umma kuanza kuyeyuka kama matofali ya barafu. Mana viongozi walipoteza rada huku wakisahau lengo la kupigania uhuru. Rais wa kwanza wa Kenya, Mzee Jomo Kenyatta, akatuanzisha vibaya kwa kutushindilia katika mfumo wa kinyama wa ubepari. Badala ya sera za kuhakikisha ardhi na rasilimali za kitaifa zinatumika kwa ajili ya maendeleo ya kunufaisha na kuinua kila mtu katika jamii na kila sehemu ya Kenya, akachagua sera za kufanya rasilimali za kitaifa kumfaidi yeye binafsi, jamaa yake, marafiki zake na watu wachache huku akibagua sehemu zingine za nchi. Badala ya kujenga taifa lenye msingi katika mfumo wa ujima uliyokuwa sehemu ya utamaduni wa makabila mengi ya Kenya, Kenyatta akatutumbikiza katika mfumo wa kushindana, kunyang’anyana, kuporana, kunyakua, kunyonyana, kudanganyana na kudhulumiana.

Badala ya kukuza mbegu za kidemokrasi, haki za binadamu, umoja wa kitaifa na kuheshimu utu wa kila mtu, akapanda mbegu za imla, nyanyaso, uvunjaji haki za binadamu na uhasama kati ya makabila ndugu ya nchi yetu. Badala ya kufundishwa kuzingatia haki na usawa, Wakenya wakaelekezwa kuabudu pesa, ulafi na kutumia madaraka kujitajirisha kwa ufisadi na wizi wa mali ya umma. Badala ya kuimarisha Jumuia ya Afrika Mashariki, Serikali ya Kenyatta ikaihujumu na kuivunja kwa hofu ya siasa za ujamaa za Mwasisi wa Taifa la Tanziania Mwalimu Julius Kambarage Nyerere. Chini ya mfumo wa ubepari, watu wachache wakazidi kutajirika huku wengi wakididimia kwenye lindi la ufukara, ukosefu na dhiki za kila aina. Serikali zote zilizofuata, iwe ni ya Daniel Arap Moi, Mwai Kibaki na hii ya leo ya Mwai Kibaki na Raila Odinga, ziliamua kufuata nyayo za kibepari za Jomo Kenyatta. Hivi leo Kenya imetia fora katika kutekeleza sera za kibepari na kukua kwa pengo kati ya matajiri na maskini.

Umma wa Kenya ulipogundua kuwa viongozi hawakuwa na nia ya kuleta ukombozi wa kijamii na kitaifa bali shauku ya kujinyakulia na kujilimbikizia pesa, ardhi na mali kwa njia yoyote ile, ulianza kuwachukia na kuwadharau. Siku Kuu za Kitaifa zikaanza kukosewa faida na kususiwa. Maana hotuba za viongozi zilijaa uongo, utapeli na unafiki. Hivi leo ni watu wachache mno ambao huhudhuria sherehe hizi. Na wanaohudhuria huhudhuria siyo kusikiliza hotuba ya Rais bali kuona michezo na kushuhudia vituko mbalimbali. Isitoshe, badala ya sherehe za kitaifa kuleta furaha zinaleta hofu na wasiwasi miongoni mwa viongozi wanaoogopa aibu ya kuzomewa na umma wenye chuki na hasira. Wananchi kwa upande wao wanaogopa athari za maandamano ya wakereketwa wanaozatiti umma kudai mageuzi nyakati za sherehe zenyewe. Uongozi mbaya umekojolea hisia za kizalendo miongoni mwa umma na kusababisha ghadhabu, hamaki na kiherehere.

Hali ya hatari ya kiuchumi na kifedha ya ubepari wa kimataifa imeongeza tabu juu ya tabu miongoni mwa umma wa Kenya huku ikizidi kuchochea mizozo na ghasia zilizoko. Wala maisha ya wengi nchini hayataboreka chini ya mfumo wa unyonyaji wa mtu kwa mtu, ubepari. Matamshi ya Serikali ya Rais Mwai Kibaki na Waziri Mkuu Raila Odinga kuhusu haki, usawa, demokrasi, uhuru, uzalendo, utawala mwema, maadili ya kiutu, haki za binadamu na matumaini huku wakishikilia na kutekeleza sera za kibepari, ni unafiki, uhange na utapeli mtupu. Chuki zilizoko dhidi Serikali na viongozi ni chuki dhidi ya maisha duni kwa wengi miaka arobaini na sita chini ya mfumo wa ubepari. Na kadiri uchumi utakavyozidi kuyumba na kuzorota huku viongozi wakitekeleza sera za kibepari zilizofeli kwa ajili ya maslahi yao ya ulafi, watazidi kuchukiwa na umma. Ndiyo, umma unazidi kufahamu kwamba hawataona uhuru kamili ndani ya mfumo wa ubepari wala hawatakombolewa na wenye kuzingatia itikadi ya kibepari, wawe wazee wawe vijana, wanawake au wanaume. Ukweli na usemwe, barabara ya ukombozi kamili ni ya usoshalisti.

Mabadiliko ya hali ya hewa ni swala nyeti, siyo tu nchini, bali pia ulimwenguni kote. Maana hivi sasa ni bayana kuwa binadamu akiendelea na mtindo wa maisha ya ubepari, ya kutumia maliasili kiholela ili kuzalisha faida kwa watu wachache pasina kujali masilahi ya wengi na mazingira, dunia itahiliki hatimaye. Hivyo basi, lazima tunaoishi leo popote tulipo ulimwenguni tuwajibike kwa vizazi vya leo na kesho.

Ni katika hali hii ambapo Kenya imepeleka ujumbe mkubwa na wa hali ya juu unaoongozwa na Rais Mwai Kibaki, katika Kongamano la kimataifa kuhusu mazingira linaloendelea huko Kopenhagen, Denmark. Inatia moyo kwamba ujumbe wa Kenya wa serikali na mashirika yasiyo ya kiserikali unashirikiana na nchi zingine za Kiafrika na zile zinazoendelea kudai fidia kutoka kwa nchi za viwanda na kibepari kama Marekani, Ulaya, Japan, Canada, Urusi na China. Hivi ndivyo inavyopaswa kuwa. Kwani nchi za kibepari ndizo zinazotumia maliasili zaidi na kuharibu mazingira ya ulimwengu zaidi kwa kuzidisha joto angaani kupita kiasi na hapo kusababisha athari mbaya kwa hali ya hewa angani.

Watasema na kuamua jinsi wanavyoamua huko Denmark, ila ukweli wa mambo ni kwamba Ili kuhifadhi uhai ulimwenguni, mfumo wa ubepari unaofuja maliasili na kujenga maadili ya kutumia rasilimali kiholela na kwa ulafi na kwa ajili ya watu wachache tu, lazima ukomeshwe. Mitumba ya nguo na bidhaa tilatila za viwanda inayotiririka kutoka nchi za Magharibi hadi za Kusini kama Kenya, ni dhihirisho la mtindo maisha wa kuponda mali kufa kwaja ambao ni utamaduni wa nchi za kibepari, lakini ambao unaharibu mazingira, kuzidisha joto angani huku ukifuja maliasili na maumbile.

Nchi Kaskazini, pamoja na Uchina, zinabugia malighafi kutoka nchi za Kusuni kama Afrika kwa ajili ya viwanda vyao. Wakati huohuo nchi za Kusini zinashindiliwa bidhaa za viwanda kutoka Kaskazini. Isitoshe, nyingi ya bidhaa hizo ni mitumba, si za umuhimu wala hazihitajiki na idadi kubwa ya watu wa nchi Kusuni. Tena zinazidisha uharibifu wa mazingira. Ndiyo kwa maana, ili Kongamano la Denmark lifaulu, sharti nchi za Kaskazini na Uchina ziwajibike, lazima zifidie nchi za Kusini zinazoathirika vibaya zaidi kutokana na mabadiliko ya hali ya hewa yanayochangiwa maendeleo ya kibepari kaskazini na Uchina. Fauka ya haya, lazima nchi za Kaskazini na Uchina zifanye ahadi za kweli za utekelezaji wa mikakati halisi ya kupunguza viwango vyao vya kuongeza joto angani.

Tayari athari za mabadiliko la hali ya hewa zimeathiri vibaya kila sehemu na jamii Kenya: mvua haijanyesha jinsi ilivyokuwa imetabiriwa na wataalamu wa hali ya hewa; kilimo kinafeli kwa kuzidi kwa ukame; maelfu ya mifugo imekufa kwa kukosa malisho na maji na jamii za wafugaji sasa zinadorora kwa kukosa lishe, dhiki na ufukara; njaa bado inayoendelea nchini bado ni mtikisiko wa kitaifa; chemichemi za maji zinapotea huku mito ikikauka; wanyamapori pia wanakufa kwa njaa na kiu; vita kati ya binadamu na wanyamapori vimeongezeka; usalama unazoroteka huku vita vya kikabila vya kuibiana mifugo na kushindania maliasili vikiongezeka; umeme umepungua na kughalika; ufukara unakua kila siku miongoni mwa umma; uhalifu unazidi; uchumi unayumba na kukwama.

Ndiyo kwa maana hatutasita kukariri: mabadiliko ya hali ya hewa ni mtikisiko wa kitaifa, ni hali ya hatari, ni swala la kufa na kupona. Ni jukumu la kila mtu popote pale alipo kujitahidi kiasi cha uwezo wake wote kuchangia uhifadhi wa mazingira. Mvua ikinyesha tupande miti; tuhifadhi chemichemi za maji na sehemu za unyevunyevu; tulinde mito na maziwa yetu; tulime huku tukihifadhi udongo; tulishe siyo kwa ajili ya kuwa na mifugo mingi tu ya kuonekana bali ili itusaidie na pia isiharibu mazingira; tujitayarishe kuhifadhi maji ya mvua kwa ajili ya matumizi ya nyumbani na kilimo; tuzidishe juhudi za kupanda mimea ya chakula huku pia tukifufua ile ya kienyeji na tupeane mwamko wa uhifadhi wa udongo. Tuishi maisha bora lakini rahisi.

Tusiponde maisha wala kutumia bila kujali au kuhifadhi. Tukatae mfumo wa ubepari na mtindo wake wa maisha. Aidha, tuanze kujiuliza: je, ni lazima tuzikane kwa majeneza ya mbao? Ni misitu ngapi inayokatwa kila siku ili kutengeneza majeneza? Tunawezaje kuhifadhi misitu huku tukikata maelfu ya ekari za miti nchini ili tu kuzizika na maiti chini ya mchanga kila siku? Hakika tunaweza kuzikana kwa heshima na kiutu bila majeneza ya mbao.
Mwisho, inasikitisha sana kuwa Serikali ya PNU na ODM iliyoko inaendelea kuwa kikwazo cha uhifadhi wa mazingira. Bado inasitasita katika kutekeleza sera ya kuhifadhi Msitu wa Mau na misitu mingine nchini. Sera ya kitaifa ya ardhi itakayosadia matumizi ya haki ya ardhi inayoambatana na uhufadhi wa mazingira bado ni ahadi tupu kutoka kwa serikali hii. Inaonekana kuwa viongozi hawana haja ya kulinda uhai wa nchi bali kuhifadhi viti vyao vya uongozi kutumia siasa duni za kujipendekeza. Ili kuhifadhi mazingira na kuokoa nchi lazima tufanye mageuzi.

Mnamo mwaka wa 2012 tuwafanye wawe viongozi wazalendo wanaojali masilahi ya kitaifa na ya binadamu wote. Maana bila kuwa na uongozi wa kutekeleza sera za haki, usawa na usimamizi bora wa maliasili kwa manufaa ya kila wa mtu wa kizazi cha sasa na chijacho, tutaangamia hatimaye kama taifa na kama binadamu. Fauka ya haya pia tutaangamiza viumbe vingine na uhai duniani.

Ukweli wa Mambo: Sera ya Kitaifa Ardhi-Gangaganga za Mganga

SERA YA KITAIFA YA ARDHI – GANGAGANGA ZA MGANGA

Gangaganga za mganga humpa mgonjwa matumaini ya kupona. Bali kuna tofauti ya matumaini ya kupona ambayo yanaweza kumuongezea mgonjwa muda wa kuishi na kupona kwenyewe hasa. Mara nyingi tume mbalimbali ambazo huundwa na Serikali mara kwa mara kuhusu maswala tilatila, mkiwemo ya ardhi, zimekuwa gangaganga za mganga tu ambazo zimewapa wananchi matumaini ya bure kwamba swala nyeti la ardhi linashughulikiwa na kuletewa ufumbuzi wa kudumu.

Kumbe mapendekezo yanayofanywa na tume za ardhi kama ile ya Njonjo na ya Ndung’u hayatekelezwi hata chembe wala hayakusudiwi kutekelezwa. Na hii ni baada ya kutumia mamilioni ya fedha za umma. Badala yake kunaendelea kuundwa tume juu ya tume zote zikiwa na nia za kupoesha harakati za umma za kudai ukweli na haki. Katika historia ya Kenya tume zimekuwa mbinu za Serikali za kuwasukia na kuwavalisha vilemba vya ukoka hususani makabwela wanaodai haki juu ya ardhi na maliasili.

Majuma machache yaliyopita tumepokea habari nzuri kwamba kuwa sera ya kitaifa ya ardhi hatimaye imepitishwa na Baraza la Mawaziri. Kwa sababu swala la ardhi ni nyeti, imechukua muda mrefu mno kutoka sera hiyo iandikwe hadi ipitishwe na Baraza la Mawaziri. Na bado, hakuna sera ya kitaifa ya ardhi nchini. Maana lazima ijadiliwe na kupitishwa na Bunge. Kutokana na mapendekezo yaliyoko ndani ya sera hii ya kitaifa ya ardhi, mengine yakikaribia kuwa ya kimapinduzi, sioni jinsi itakavyopewa kipaumbele na bunge hili lilojaa makabaila. Na hata ikijadiliwa, sioni jinsi itakavyopitishwa. Na ikipitishwa itakuwa imevunjwa makali na kubaki kifuu kitupu ambacho hakifai sumni kwa masilahi ya Wakenya wengi wanaolilia ardhi. Na hata sera hii ikipitishwa pasina mabadiliko, sioni sera ya ardhi ya kitaifa ikitekelezwa na Serikali hii kwa masilahi ya kitaifa na ya makabwela wengi ambao wanahitaji ardhi ya kuzalisha chakula, makao na mahitaji mengine muhimu. Wala sioni jinsi Serikali iliyoko ambayo inaongozwa na makabaila wanaomiliki maelfu ya maekari ya ardhi kila pahali nchini itakubali kutekelezwa kwa Sera ya kuwanyang’anya ukiritimba wa ardhi ambao umewafanya na unaendelea kuwafanya mamilionea na mabilionea. Si rahisi kumnyang’anya mbwa mfupa wa nyama uliyoko mdomoni. Tena tunajua kinyozi hajinyoi na akijinyoa hujikata.

Dalili ya mvua ni mawingu na mwanzo wa ngoma ni lele, kama Waziri wa Ardhi ana nia na uwezo wa kutekeleza sera ya ardhi basi angelikuwa anaendelea kutekeleza mapendekezo ya tume ya ardhi ya Ndung’u yanayohusu ardhi ya umma iliyonyakuliwa na watu binafsi kote nchini. Lakini kwa sababu mapendekezo ya tume ya Ndung’u yamewahusisha vigogo, baadhi yao wakiwa viongozi wa Serikali, katika unyakuzi wa ardhi ya umma, haijatekelezwa hadi sasa. Isitoshe, mbona kinyang’anyiro cha ardhi kinaendelea Pwani na kote nchini kuliko wakati wowote mwingine? Ukweli wa mambo ni kwamba sera yoyote ya kuleta haki na usawa nchini haiwezi ikatekelezwa na Serikali inayoongozwa na wanaofaidi kutokana na dhuluma na ufisadi. Tangu lini fisi akajihukumu kwa kosa la kumla mwanambuzi?

Sera ya kitaifa ya ardhi ni muhimu na inahitajika sana maana itatoa mwelekeo kuhusu mfumo wa umilikaji wa ardhi na jinsi ardhi itapangwa na kuhifadhiwa kwa ajili ya vizazi vya sasa na vijavyo. Hivi sasa kuna sheria nyingi mno za ardhi ambazo zinakinzana na kutatanisha. Kupitia kwa sera ya kitaifa ya ardhi ama katiba mpya ya kitaifa kunaweza kuundwa sheria chache tu ambazo zitatoa mwelekeo wazi na bayana uliyo madhubuti wa kutatua maswala ya ardhi mahakamani.

Sera yoyote ya ardhi ya kimaendeleo sharti izingatie kwamba ardhi ni mali ya kitaifa, ya vizazi vya sasa na vijavyo na hivyo basi kila raia ana haki na jukumu ya kuitumia, kuifaidi na kuihifadhi. Si sahihi kuendelea kuwa na wananchi wasiyo na haki ya hata inchi ya nchi yao. Ardhi inafaa kupangwa, kutumiwa na kuhifadhiwa kwa ajili ya kuzalisha mahitaji ya chakula, nguo, makazi na mambo yote muhimu na ya kimsingi ya kila raia wala si kwa ajili ya ulanguzi na walanguzi. Si sahihi kuendelea kuwa na jamaa zenye kumiliki mamia ya maelfu ya ekari ya ardhi wakati wengi wanakosa hata ardhi ya kujengea jamaa zao na kuwalimia chakula. Swala la maskwata linahitaji kuondolewa huku mikakati mahusisi ya kuondoa mitaa ya mabanda ikihitajika kufanywa na kutekelezwa. Wakati umefika wa kutekelezwa kwa mipango ya matumizi ya ardhi yenye lengo la kufanya miji yetu kuwa misafi, ya kupendeza na ya ustaarabu. Aidha, jamii za nchi yetu zipewe uwezo wa kusimamia ardhi na rasilimali za ardhi kwenye maeneo yao huku ardhi ikipewa wale wanaoifanyia kazi kwa mahitaji muhimu ya jamaa na taifa.

Bali haya yote ni mapendekezo. Na nchi hii haina upungufu wa mapendekezo na sera. Kenya ina ukame wa maongozi na viongozi wenye nia na ujasiri wa kutekeleza sera za kuhakikisha kuwa kila Mkenya anafaidi kutokana na ardhi na maliasili ya Kenya. Viongozi wa sasa, wanaoongozwa na tamaa na shauku za utajiri wa kibinafsi, wana haja na kutumia ardhi na mali asili kujitajirisha wao na jamaa na marafiki zao tu. Hawajali makabwela wala masilahi ya kitaifa. Ili kuleta na kutekeleza sera ya kitaifa ya ardhi ya kimaendeleo, hatuna budi kuwaondoa na badala yake kuwaweka uongozini wazalendo wenye kuongozwa na itikadi ya ujamaa yenye msingi katika masilahi ya umma.

Ukweli wa Mambo: Kura Za Maoni za Synovate Zahatarisha Demokrasi Nchini

Mfumo wa vyama vingi Kenya ulipatikana Kenya kutokana na mapambano makali na ya muda mrefu. Katika mapambano hayo, wazalendo, wakereketwa wa demokrasi na haki za binadamu waliwindwa, walikamatwa, waliteswa, walishtakiwa chini ya sheria za kiimla zilizotekelezwa na mahakama bandia, walifungwa, walilazimishwa kuwa wakimbizi wa ndani na nchi za nje na hata wengi waliuawa. Chini ya mfumo wa chama kimoja cha KANU, tawala za Jomo Kenyatta na Daniel Toroitich arap Moi zilitia fora katika kuvunja haki za binadamu za Wakenya kiholela.

Kenya ilitawalwa kama falme za watu binafsi, Marais, ndipo ufisadi, uporaji wa mali ya umma, kinyang’anyiro cha mashamba, ukabila na umbari – haya yote yakakua donda ndugu na sehemu ya utamaduni mwovu wa nchi yetu. Wakenya wakachukuliwa na Kenyatta na Moi kama watumwa ndani ya nchi yao wenyewe huku wakinyang’anywa uhuru wa kusema, kusoma, kukutana, kusambaza maoni yao na kuchagua viongozi wanaowataka. Hata Rais mstaafu Daniel Toroitich arap Moi, ambaye sasa anafurahia matunda ya demokrasi aliyoipiga vita siku zote za utawala wake, atakubaliana nami kuwa maisha chini ya mfumo wa imla wa chama kimoja yalikuwa mabaya na machungu mno kwa Wakenya. Heri haya ya mfumo wa vyama vingi.

Ndiyo kwa sababu lazima tuutetee mfumo wa vyama vingi kwa vyovyote vile. Mfumo wa demokrasi ya vyama vingi ni pato la mapambano ya umma wa Kenya. Lazima tutetee pato hili lilotokana na mapambano huku tukiendelea kudai mageuzi zaidi ya kuboresha maisha ya wengi nchini ambao bado wanaendelea kuishi maisha ya ufukara; njaa; ukosefu wa ardhi, makao na ajira; uzorotaji wa usalama; na kunyanyaswa na makabaila na mabwanyenye. Historia inatuonya kwamba tusipotetea mapato ya mapambano yetu yanayotuongezea demokrasi na uhuru zaidi, kuna hatari ya kunyang’anywa na wapinga maendeleo ambao daima wanaogopa na kuchukia ukombozi wa wengi ambao wananyonywa na kugandamizwa kwa kila hali.

Nasema hivi kwa sababu nina shaka na kura za maoni zinazotangazwa na Kundi la Synovate ambalo hutoa takwimu kuhusu wanasiasa wachache mashuhuri ati ambao ndiyo wanaotarajiwa kuwa Rais wa nchi yetu. Isitoshe, utafiti wao unaofikia uamuazi wa kusema nani kiongozi mashuhuri zaidi kadamnasi ya wananchi unaashiria kutokuwa na nia njema kwa demokrasi ya mfumo wa vyama vingi.

Siamini kuwa Synovate wanaweza kuwa wakifanya kazi ya kutoa takwimu hizi mara kwa mara bila kuwa na dhamira maalamu kuhusu uongozi wa Kenya. Katika nchi za kibepari, kile kinachoitwa kura za maoni ya wananchi ya mara kwa mara hutekeleza lengo maalumu la kuathiri fikra za raia kuhusu jambo fulani au uchaguzi kupendelea viongozi, vyama na sera fulani. Swali ni kwamba, wanaodhamini utafiti wa Synovate ni kina nani na wana nia gani?

Kulingana na ’utafiti’ wa Synovate watu wanaotarajiwa kuwa Rais wa nchi yetu ni Raila Odinga, Kalonzo Musyoka, Uhuru Kenyatta, Wiliam Ruto na Martha Karua. Swali ni, je, kwa nini Synovate waliuliza wananchi waliyowauliza kuhusu viongozi hawa tu wakati sasa kuna vyama arobaini na saba ambavyo vimesajiliwa kufungamana na Sheria ya Vyama vya Kisiasa ya 2007? Jibu la swali hili linatuelekeza tufikirie kwamba shabaha ya kura za maoni na utafiti wa Synovate ni kuwafanya Wakenya wafikirie hawana budi ila kuchagua Rais kutokana na wanasiasa hawa watano tu na vyama vyao.

Maana yake ni kwamba, hata ingawa kuna vyama vya kisiasa arobaini na saba vilivyosajiliwa, ati Wakenya watapaswa kuchagua Rais kutoka kwa ODM ama ODM – Kenya, KANU au NARC-Kenya. Hili linaogopesha! Maana ni kama kusema hakuna watu wengine Kenya ambao wanaweza kuwa Rais isipokuwa hawa tu wanaotafitiwa na kuzungumziwa na Synovate. Pia ni kana kwamba vyama vingine vya kisiasa ambavyo vinapuuzwa na Synovate haviwezi kuwa na mgombea wa Rais ambaye atafaulu kufanywa Rais na Wakenya.

Lakini ukweli ni kwamba viongozi hawa watano wanaopigiwa debe na Synovate ni sehemu ya serikali iliyoko na itikadi na siasa zao zinajulikana kwa kila Mkenya. Wao ni sehemu ya uongozi ambao umeshindwa kusuluhisha matatizo chungu nzima ya kisiasa, kiuchumi, kijamii, kiusalama na kiutawala ambayo yanaendelea kuikumba nchi yetu? Wao ndiyo wanaotekeleza sera za ubinafsishaji wa kiholela wa mashirika ya umma na kuzidisha pengo kati ya matajri na maskini. Basi ikiwa itatubidi kuchagua Rais kutoka kati yao peke yake mnamo mwaka wa 2012 kuna maana tayari imeamuliwa hapatakuwa na mabadiliko ya uongozi na sera Kenya? Ati mambo yataendelea kuwa hivi hivi tu?

Maana hakuna mambo mapya yataletwa na kufanywa na kina Raila, Kalonzo, Ruto, Karua na Uhuru ambayo yamewashinda kufanya sasa wakiwa bungeni na serikalini. Swali ni, je, kwa nini utafiti wa Synovate unaendelea kusisitiza kuelekeza wananchi kuchagua Rais kutokana na wanasiasa hawa watano tu na vyama vyao tena wenye itikadi moja?

Utafiti wa Synovate hauwaoni wala hautaki kuwaona wala kuwauliza wananchi maswali kuhusu vyama vingine vya kisiasa na viongozi wao. Ndiyo kwa sababu nakariri, utafiti na Synovate na kura zake za maoni kuhusu viongozi unaelekea kupinga mfumo wa vyama vingi huku ukipendelea vyama vichache vyenye itikadi moja ya kibepari. Kenya tulipigania mfumo wa vyama vingi siyo vyama vichache. Isitoshe, ni kana kwamba ni mbinu za kuwachagulia Wakenya viongozi. Hatutaki kuchaguliwa viongozi tena, tulitoka huko zamani. Pia kura za maoni za upendeleo siyo tu zinapinga demokrasi bali zinaweza kuhatarisha amani na usalama wa kitaifa, hebu tukumbuke ghasia za baada ya uchaguzi wa 2007. Tom Wolf na Synovate mwanisikia?

Ukweli wa Mambo:Pesa ya Uma Si Mali ya Binafsi

Habari kwamba Serikali imetenga shilingi milioni thelathini na tatu kwa ajili ya kukarabati nyumba za binafsi za Waziri Mkuu ni za kushangaza, kushtusha, kutisha, kuhofisha na kukasirisha. Labda ni tetesi zisizo na ukweli zinazosambazwa na vyombo vya habari. Pamoja na ufisadi uliyokolea nchini na ulafi wa pesa na mali wa viongozi wa nchi hii, sikutarajia kwamba hili lingelifikirika, kusadikika au kufanyika, tena hadharani na bila haya wala aibu. Bali penye moshi hapakosi moto na lisemwalo lipo na likiwa halipo li njiani linakuja.

Tulikuwa tunalaani ufisadi uliyonoga na kunawiri nyakati za utawala wa Moi, kumbe ukishangaa ya Musa utaona ya firauni! Pesa za Serikali ni pesa za umma na kamwe hatuwezi kukubali zigeuzwe mali ya binafsi na kutumiwa vururumtende. Kutumia pesa za umma kwa masilahi ya kibinafsi ni udanganyifu, wizi, ufisadi na uhalifu. Haiwezi kuwa vingine. Kuchukua milioni thelathini na tatu ya pesa za umma na kuzitumia kukarabati nyumba za binafsi za Waziri Mkuu bila shaka ni kupora mali ya umma. Tena, haijalishi ni kiasi gani, mali ya umma ni mali ya umma hata ikiwa ndururu, hivyo si haki au halali ibinafsishwe. Waziri Mkuu akikubali kukarabatiwa nyumba zake za binafsi na pesa za umma basi atakuwa amekubali kushiriki uhalifu. Ushauri wangu ni akarabati mali yake na pesa zake, najua anaweza. Asikubali kushiriki katika kujenga utamaduni huu wa kuhalalisha wizi, ufisadi na uporaji wa ushuru wa raia.

Ikiwa Bunge limekubali kuidhinisha pesa za umma kutumiwa kukarabati nyumba za binafsi za Waziri Mkuu, ama mtu yoyote, basi limewasaliti wananchi wa Kenya na vilevile limeshiriki katika jinai. Nikisema hivi, naamini kuwa Waziri Mkuu ana haki ya kuwa na maskani ya kustahili wadhifa wake na majukumu yake ya kitaifa. Maskani yake yanaweza kugharimu hata milioni mia moja au zaidi. Ajengewe majumba hayo, lakini bora tu yawe mali ya Serikali ambayo atayatumia hadi atakapomaliza kazi yake. Lakini kutumia mali ya umma kumjengea ama kumakarabatia mtu yoyote yule nyumba zake binafsi zitakazorithiwa na jamaa yake si sahihi hata kidogo.

Rais mstaafu, Daniel Arap Moi, hangelipewa majumba ya Serikali yaliyoko Kibera aliyokuwa akiyatumia akiwa rais. Hiyo ilikuwa mali ya umma na ni makosa yazawadiwe mtu binafsi hata awe nani. Angehamia majumba yake binafsi na kuyaacha majumba hayo kutumiwa kwa shughuli za Serikali. Je, tukijenga utamaduni wa viongozi kurithi mali ya umma, si Rais anaweze kutarajia kurithi hata ikulu ya Rais atakapomaliza muda wake? Aidha, tamaa ya kujilimbikizia mali ikiwa ni pamoja na ya wizi, itawapeleka wapi?

Tukiacha haya ya tamaa mbele mauti nyuma, tugusie ya haki na sheria. Nayo sheria ni msumeno, hukata mbele na nyuma. Habari kuu za kila siku ni kuhusu ikiwa watu, mkiwemo viongozi wa nchi, ambao wanatuhumiwa kwa kupanga, kuchochea na kudhamini ghasia za baada ya uchaguzi, watashtakiwa hapa nchini, huko Uholanzi ama wataundiwa tume ya ukweli, haki na maridhiano. Baraza la Mawaziri linababaika wala halina mwelekeo. Nani atakuwa pweza wa kujikanga na mafuta yake mwenyewe? Shinikizo kubwa zaidi za haki na kisheria zinazotingisha nakutetemesha Serikali hii ni zile za kutoka nje, za kibeberu. Walisaini Mkataba wa Roma, nao Mkataba wa Roma na Mahakama ya Uhalifu ya Kimataifa ni ukolonimamboleo. Kenya si huru tena, inaongozwa na mikataba na sheria za kibeberu.

Viongozi wanaouabudu ubeberu hadi kusaliti nchi kwa kukubali majasusi na polisi wa kigeni kuingia huku kuwakamata, kuwahoji, kuwatesa, kuwateka hadi nchi za kigeni na hata kuua wananchi, sasa wenyewe wanaandamwa na mabeberu. Kumbe mchimba kisima huingia mwenyewe. Siwahurumii maana hawana huruma hata kidogo hawa vigogo watuhumiwa. Bali naona uchungu kwa nchi yetu ambayo imefikishwa kwa hali ya kupoteza uhuru wa kitaifa. Serikali gani inayokubali kusomewa na kukemewa na mabalozi wa kigeni usiku na mchana?

Ndiyo, wazimu huu lazima uwe na kikomo. Uhalifu ni uhalifu, bahasha ifunguliwe na watuhumiwa wajulikane, wakamatwe, wawekwe korokoroni na kushtakiwa nchini, huko Uholanzi ama popote pale. Watuhumiwa wenye vyeo serikalini waondoke ama waondolewe na kufuata wenzao korokoroni na mahakamani. Hii ndiyo sheria na haki yao wenyewe, wanaitumia kwa makabwela bali leo imewafikia. Mwosha huoshwa. Tusikubali tume ya ukweli, haki na maridhiano yenye shabaha ya kuwasamehe na kuwawachilia waliyopanga na kutekeleza njama za kuwaua wengine maksuudi. Ikiwa tutawasamehe wahalifu wa ghasia za baada ya uchaguzi basi basi tuwasamehe wahalifu wote, tuwafungue wafungwa wote nchini na kuanza upya. Njama za mwamba ngozi kamba kuvutia kwake hatuzitaki.

Jambo la muhimu zaidi ni kwamba chochote kile kinachohitajika kufanywa ili kuiondoa Serikali hii kutoka madarakani kwa njia za kidemokrasi, kifanyike haraka iwezekanvyo. Serikali hii imechafuka kadamnasi ya wananchi na kimataifa Isitoshe imeshindwa kulinda uhuru wa kitaifa. Na inende kunenda!

Ukweli Wa Mambo: “VIP Shipping International” Is A Fake Company

When the “Kinyua container” scandal first  broke out over the week-end, the general line of thought was that VIP Shipping company that was at the centre of the scandal and a Mr. Kristian who was allegedly subcontracted by the Kenyan Embassy in Stockholm to ferry the container of diplomat Kinyua to Canada were acting in concert.

According to fresh details, VIP Shipping Company is a fraudulent Company that has fleeced numerous customers of goods and money running into millions of kronors. Mr. Kristian, whose full names are Kristian Vendelbo, is the brain box behind the chain of fraud using the Company which claims to have its headquarters in London with non existent branches spread across the world.

In reality, the address given by the company of their office in London does not exist while another address given by the company in Denmark – Diplomvej 381, 2800 Lyngby, does not exist either.

At a Danish website, 1.000 Dannish kr is being offered to anybody who can give police information that could lead to the capture of Mr. Kristian who is wanted in that country for a series of fraudulent transactions that have left many Danes miserable after they lost goods in containers. Kristian is said to drive a red Volvo with registration number VY 53 282.

The Kenyan Embassy fell into Kristian’s trap because the Lady diplomats at the Embassy swallowed, bait, hook and sinker, the con man’s key strategy – a considerably low price on container transport – in a shady transaction that smells of kick-backs and under the table dealings before the operation went sour, ending in Mr. Kinyua hanging on the verge of losing his entire private property that constituted his entire house-hold in Stockholm.

In April this year, Markus, a Swedish national, fell victim to Kristian’s tricks when he was moving from the United States to Sweden after completing his studies. He packed his personal effects in a container (including a car) and wired Mr. Per Nygren, his father, to link up with a Company that could help with container transport.

The father took contact with VIP Shipping through a fake office in Denmark but when the son arrived in Sweden, the container could not be released by CMA-CGM, the third largest container handling company in Göteborg, because Kristian had not paid up. By the time the container was released, the bill had reached 32,000 kr with extra storage charges being responsible for the price increase.

If Mr. Kinyua is lucky, his container could be lying somewhere but it may have to be paid for a fresh (including payment for storage charges when the container remained stranded). If Kristian did not sub contract any company to transport the container then simply failed to pay the company, Mr. Kinyua runs the risk of losing everything.

KRISTIAN VENDELBO AND A STRING OF FAKE COMPANIES
The modus operandi of Kristian is that he offers a very low price, subcontracts another company to do the job then fails to pay the company which, in turn, fails to release the container. The customer is then left to sort out the mess.

In another case, a Ugandan family linked to a diplomat who was working at the Ugandan Embassy in Denmark had to pay 200.000 kr (2 million Kenyan shillings) to a container company in Mombasa to help them get their goods after Kristian tricked them.

The Embassy had hired Kristian’s VIP Shipping International which subcontracted another company to do the job. Kristian was paid 94.500 kr by the Ugandan but instead of finishing the transaction by paying the Mombasa company, he simply disappeared. The diplomat had to hire a lawyer to help him trace the container while he lost cash paid to Kristian besides the Ksh 2 million extra expenses.

Then came the case of Samanta Dominquez, an Argentine diplomat, who was moving back to Brazil after her tour of duty came to an end. She took contact with VIP Shipping through Kristian but three months after she arrived in Argentina, her property had not arrived yet. She reported the matter to police and eventually hired another company to trace her cargo which she received at long last.

In the case of Karen Bygdhal Andreasen, her property was supposed to be transported from Antwerp, Belgium to Sao Paolo in Brazil so she took contact with Kristian Vendelbo and his VIP Shipping International. Kristian promised Karen that her goods would be in Sao Paolo in November 2006 but by September 2007, her goods had not arrived neither could she trace the container, forcing her to report Kristian to police.

Mark Lesurf, another victim, paid VIP Shipping 13.000 kr through Kristian who promised to move his goods from the United States to Copenhagen but the goods were never delivered.

An Opera musician called Ingeborg Børch who had been residing in London for 4 years, wanted her personal effects moved to Denmark so she took contact with VIP Shipping through an advertisment. Among her personal effects were her concert instruments. Kristian gave her an attractive discount that was too irresistable – 23.000 kr for the job. Three months later, her goods had not arrived at their destination although Kristian continued to assure her that the goods were on the way. On 30th July last year, she reported Kristian to police.

Kristian is a known conman who operates several fake companies to evade detection. VIP Shipping is just one of his numerous shell companies. Others are: VIP-Ship, A-1 Relocation, A-1 Relocations, VIP-Møbeltrafik, VIP Flytteservice, VIP International Shipping Systems, Shipping for Diplomats, Ship4diplomats, Intership-diplomat, IntershipVIP, Ship4expats, House of Shipping and a company called Relocation.

The Embassy should take responsibility in the case of the missing container of Mr. George  Kinyua because before contracting a company to supply services on behalf of the government, it is the responsibility of Embassy staff in charge to apply the principles of ”competative bidding” as provided for in the ”Public Procurement Act of 2001” which deals with identification and award of contracts to various suppliers.

In the absence of competative bidding, the Embassy cannot acertain how the contract sums were determined and accepted by the government as faire and competative.

Any supplier of goods or services to the government of Kenya must be subjected to ”dilligence tests” as per the Public Procurement Act to establish the supplier’s competence, capacity and capability to deliver the goods or services in the contracts.

This appears not to have been done when Mr. Kristian was engaged by the Embassy and given Kristian’s history of fraud and subterfuge, any officer at the Embassy who was involved in the contract should take responsibility.

If Kinyua’s container is still packed somewhere, it will take extra government funds to recover it while in case it got lost, it is safe to assume that VIP Shipping has no insurence because it is a fake company. The question that will arise is who will foot the bill if Kinyua has to be compensated. Is it the Tax payer or responsible Embassy employees who violated the law and hired a fake company? There is no room for “We never knew” unless Kenya has become a banana Republic. Could Ambassador Purity Muhindi please give the Kenyan public an explanation?

Rejoinder To “Proudly Kenyan”

It is only in Kenya elections where a Presidential candidate steals the vote then is later sworn in to assume Office in less than an hour without the national anthem being sung, the sword of power being handed over and without the presence of the diplomatic Corpse. Don’t mind that the “invited guests” were mainly family members of “The president’s” key sycophants.  Then, the acceptance speech of the fake Prezzo says in part: “With elections now behind us…”. Sure, the riots are ahead!

In Kenya, you can create a serious crisis by stealing Presidential vote and as “talks” to resolve the crisis begins through some “eminent persons”, you sneak to an African Union summit as “President”. When you come back to Kenya, you tell the opposition complaining “to go to court” without caring about the talks! And that is after the UN Chief has already arrived in the country to “support the talks”, initiative where a former UN Chief is actually the Chief negotiator.

In Kenya, you steal elections then send your dogs to back to the effect that “there will be no negotiations with losers”. You then begin the negotiations and send the dogs away but as the agenda of the talks is being announced, you come back and say that the court system is the best option because election petitions have always been handled well in Kenya.

It is only in Kenya where police shoots a demonstrating civilian and after the action is captured on camera and broadcast on National TV news, the Police Boss comes and accuses the journalist of having “edited” the video to show that someone was shot by police. When evidence mounts, the police chief comes back on Telly and says that someone was actually shot and that action has now been taken. Kenya is a great country.

In Kenya, the Electoral Commission publishes an advert in the national dailies about contested election results then minutes later, the Chairman of that same Commission calls a Press conference and says that he doesn’t know anything about the advert because he was not consulted. Talk about Kivuitu the bandit.

Look at it this way. You loose an election in Kenya (Raphael Tuju, Musikari Kombo and former Vice president Moody Awori all lost). But in Kenya, it is OK that such losers were brought on TV News Conferences to answer questions from journalists to defend the government soon after elections were rigged. When Tuju was asked what he was doing at the Press conference yet he lost elections, he said “That is not an issue”. That is Kenya, our country.

The ban on “Live media coverage” was made by John Michuki, the Minsiter of Internal security. The ban was issued by Michuki as Minister even before the fake President announced the line up of his Cabinet. When push came to shove, Michuki ended up as Roads Minister! Only in Kenya! Besides, there is a “ban on live coverage” but news is actually being transmitted live because the news reader is always live. What happens next in Kenya? The government looks the other way! The vote of the House Speaker was transmitted live on TV despite the ban and the government did not prosecute. In other words, you can break laws before the media and get away with it. After all, elections were also rigged before the Media.

Just imagine this. An important personality like the Chairman of the Africa Union travels to Kenya urgently to try and resolve a stolen election crisis where people are being killed indiscriminately with more than quarter million internal refugees already created. When the AU Chairman arrives, the government spokesman Mutua announces that the AU boss has come to drink “a cup of tea” with the fake President. The Chairman later leaves empty handed. Only in Kenya!

Two opposition politicians are killed in less than 72 hours and before investigations can begin, the government plants stories in the media that the killings were the result of love gone sour. They call it “Love triangle”. Our country is really unique.

If you want to deal with anti-government demonstrators in Kenya, order police to shoot to kill otherwise you are losing it. That is Kenya and if in doubt, look at what Saitoti, the Minister of Internal security, told police. That is our country. If you love it, call it “business as usual” in the post election period!

You have a neighbor at Kibera slums and you have been borrowing one another stuff like salt, onions, tomatoes et al for more than 15 years. He is not a member of your tribe though. But once elections are rigged, you take a machete and cut his/her throat because the one who has rigged elections comes from his/her tribe. Don’t say that this happened in Rwanda because there, elections were not rigged! Its only showing in Kenya. 2B Continued…

The land was grabbed by a ”white settler” during the days of colonialism and to date, nothing has changed despite “Independence”.

“Ukweli Wa Mambo” Download (May-June 2007)

“Ukweli wa Mambo” is a Swahili Newsletter produced by Hon Mwandawiro Mghanga who is currently being harassed by the Kibaki dictatorship using false accusations that he is a member of Mungiki. KSB will soon set up an “Ukweli Wa Mambo” link so that readers can follow the Mwandawiro contributions. Mwandawiro has been exiled in Sweden and returned to Kenya to practice politics.

It is therefore unthinkable that a government that was elected on a platform of change could begin to harass and intimidate a patriotic Kenyan like Mwandawiro who has made great contributions to the struggle for democracy and human rights in Kenya. Hon Mwandawiro has not only gone to jail because of his political beliefs but was also forced into exile soon after his release from prison. 

KSB condemns the current intimidation of Hon Mwandawiro by the Kibaki government which is using false pretences to take Mwandawiro out of the scene because of fear that Mwandawiro is radicalizing his constituents especially on the thorny issue of stolen land in Wundanyi constituency which he represents. Thousands of people in Wundanyi are landless while a few rich land owners have grabbed thousands of acres of land in the constituency.

The situation is the same in the Rift valley where thousands of Kenyans are landless while white Europeans are still owning vast pieces of land stolen from Wananchi. Just like all progressive Kenyans, KSB will continue to defend Mwandawiro against witch hunting and unfounded attacks by the Kibaki government.
