The Ocampo 4: June 12th date with ICC Judges

The trial preparations of the four Kenyans facing charges at the International Criminal Court kicks off in earnest on June 12 when the accused and their lawyers are scheduled to gather at The Hague for a preparatory conference. A source familiar with the trial preparations told the Sunday Nation from The Hague that trial judges have notified the parties to attend the status conference during which the rules of engagement will be defined including procedural matters and sequence of proceedings.

The status conference lays ground for the trial proper whose date would depend on the issues raised and efficiency of the parties.

During the meeting, the parties would have their first interaction with judges Christine van den Wyngaert (Belgium), Kuniko Ozaki (Japan) and Chile Obeo-Osuji of Nigeria who will preside over the trials. (READ: Japanese elected lead judge in Kenya chaos cases)

The court’s decision is likely to dampen the spirits of President Kibaki who is engaged in a last ditch effort — both at home and abroad — to stop the proceedings at The Hague-based court.

It comes barely two weeks after he indicated to Parliament the government’s determination to set up a local court to try those suspected to have sponsored the 2008/9 violence.

Days later, the President secured a resolution by the East Africa Community for the expansion of the jurisdiction of the East Africa Court of Justice to handle the Kenyan cases.

Similar efforts are underway at a gathering of legal experts from the African Union working on a similar resolution. (READ: AU moves to take over Hague cases)

The lawyers meeting in Addis Ababa are exploring ways of implementing a January resolution of AU leaders seeking to expand the scope of the Africa Court of Justice to enable it to take over ICC cases involving African leaders — Sudan President Omar al-Bashir and Kenya’s Deputy Prime Minister Uhuru Kenyatta, Eldoret North MP William Ruto, former Head of Public Service Francis Muthaura and radio journalist Joshua Sang, who were on January 23 committed to trial for crimes against humanity committed during the violence.

During the conference, judges will set a timetable for the start of trials and disclosure of witnesses and evidence between the prosecutor and defence. The accused have an option of attending the conference in person.

Mr Karim Khan, who is leading Mr Muthaura’s defence team, on Saturday confirmed the summons and said he would attend the conference with members of his team.

However, he was no-committal on whether his client will be present. “It is a usual court occurrence during which issues are agreed upon relating to evidence, procedure and sequence of the proceedings. Attendance of the accused at status conferences is optional,” he said in a phone interview.

The Muthaura defence includes Mr Ken Ogeto of the Kenyan Bar, Malaysian Shyamala Alagendra and Mr Essal Faal from The Gambia while Mr Kenyatta is represented by British lawyers Steven Kay and Gillian Higgins.

A lawyer who spoke under the cover of anonymity said by the decision, the ICC had “called the government’s bluff”. “The ICC is testing the government and suspects’ commitment to co-operate with the court,” he said.

Explaining the significance of the conference in a recent conversation, ICC spokesman Fadil Abdallah said it is largely a house keeping affair.

“The parties will present their observations to the chamber on their preparedness, which will review them and establish a timetable for trials proper,” he said.

Commenting on Saturday, Senior Counsel Paul Muite advised Mr Ruto and Mr Uhuru to review their defence strategy and composition of their lawyers.

“They should have faith in Kenyan lawyers because they understand the history and context of the case,” he said citing the success of Tinderet MP Henry Kosgey and Maj (Gen) Hussein Ali’s during the confirmation of cases hearings.

Who Will Rescue Begging Magdalene from Stockholm’s Streets?

When Juliet Kavinga, a Kenyan woman, was murdered by a Swede some years back, Kenya-Stockholmers were outraged. While the anger was directed towards the Swedish murderer, members of the Kenyan community in Stockholm also blamed themselves for failing to detect the dangerous circumstances under which Juliet was living. Eventually, Juliet was also blamed post-humously “for isolating herself” and creating the circumstances under which she was killed. If she had been open with Kenyans, so went the argument, she could have been advised to keep away from the Swede because the guy was disinterested in the baby and could therefore harm her, went the conclusion. Unfortunately, it was too late.

Last September, Nyambu, a Kenyan woman, killed her two children sparking a round of blames within the Kenyan community. Nyambu’s friends were blamed for failing to detect that something was wrong with her even after she isolated herself after allegedly going bonkers. Emotions were poured through KSB while Nyambu’s “friends” set up a FB page “to mourn the kids”. Anybody who tried to analyse the circumstances under which Nyambu may have killed her kids was quickly deleted from the friends FB membership. The argument was that friends “were in mourning” and anything else was unwelcome. Some friends who were mourning the most had, months back, boasted of having deleted Nyambu’s phone number from their mobiles “to get rid of her” because she had become crazy. Why is the Juliet tragedy and the Nyambu case relevant?

Today, there is a Kenyan woman called Magdalene who is begging in the streets of Stockholm. In July last year, a Kenyan couple calling themselves “The Kamaus” and who were on a visit to Stockholm from Kenya, bumped into her in town during her begging escapades. The Kamaus later wrote to KSB, asking whether there is anybody who could help her because she appeared to have been unwell upstairs.

Magdalene is apparently back in the streets, begging. Her style is a bit different. Unlike traditional beggars who camp at a corner of the streets with a small bakuli on the floor, Magdalene chases white people in the streets asking them to give her 100kr. Her strange technique is said to be working with sympathetic Swedes seeking to be left alone dipping into their wallets to get out anything which will help brash her off their trail. Once she is “helped” with a few kronas, she goes gambling at the local hole and once she runs broke, she hits the streets again in an ever ending cycle.

What is strange is that on the surface, Magdalene appears to be a very normal and sane person. However, every Kenyan who knows her also knows that she is sick mentally. If you attend a Kenyan function, you could easily bump into her, well dressed, humble and very patient. In fact, she engages in normal conversation and can even discuss issues. During the 90s, Kenyans used to converge in her flat to do politics because her ex was, by then, a dissident. Some of the big names in Stockholm today used to dine at her place.

Yeah, those were the good old days when Wakenya seeking asylum used to fight against the “dictatorial Moi/KANU regime” who was torturing Kenyans under a one party dictatorship forcing many Kenyans to flee the country to avoid being arrested and killed by the Special Branch! Today, Magdalene seems to have been abandoned by everybody in typical Kenya-Stockholm style – you are only useful when you are “normal” but the moment you begin to lose it, everybody runs away from you.

Where are the good Samaritans?
This lady is a mother of two brilliant adults and it is very painful to see what is happening to her as the Kenyan community recoils into itself. What happened to being your brother’s and sister’s keeper? A mantra that was being peddled just a few months ago after Nyambu killed her children? The situation is much more serious. I will give a scenario to drive my point home.

With her daily begging missions in town, Magdalene will, one day, attract the attention of the organized wing of the Swedish Nazis known to send white Swedish blondies to lure Africans into isolated areas to be “taught a lesson”. With her poor mental health, it is very easy to drive Magdalene away with the lure of money. The Swedish newspapers are awash with news items about disappearances and therefore, this scenario is not an “out of Sweden” fantasy. As a friend of Magdalene, will you come back and mourn about what could have been done when tragedy strikes?

The Swedish system is tough. Magdalene has been married twice, a very normal experience in Sweden. The problem is that although she is unwell, even her closest friends whom she has been praying with at Bagarmossen church have abandoned her. Surely, where is: Pastor Samsang; members of her church congregation; her adult children; her close friends for many years; and even her former hubbies whom she took care of for years? Must Kenyans here wait until Magdalene ends in some tragic situation before fathoming about what could have been done?

Where are the “good Samaritans” who have been taking in renegade teenagers and keeping them in their apartments? Some Kenyans are on record for having gone to court to prevent mothers from taking custody of their rebellious teenage daughters “in the interest of the child”. Where are they?

Last year, after Nyambu killed her kids, these good Samaritans saturated the Swedish media with sympathetic faces as they mourned about their inability to help Nyambu because her case had remained obscure. Where are they to act “in the interest” of this poor woman who is actually a tragedy waiting to happen in the streets of Stockholm?

Who Will Become Kenya’s Next President?

Your guess could be as good as mine

Although more than 30 political parties have been registered in Kenya, the real battle for the Presidency will be fought on two fronts. On the one hand will be a conglomeration of Parties seeking the retention of power by the corrupt and filthy-rich Kikuyu ruling elite while on the other will be a cluster of parties seeking to dismantle the power structure of this class which has ruthlessly looted the country’s resources since the days of Kenyatta before President Kibaki came to power about a decade ago, principally to perpetuate the status quo.

The bottom line is that parties vying for power in Kenya, from ODM, PNU, NARC-Kenya, FORD-Kenya, URP to UDF, New Ford Kenya, Kenya National Congress and Wiper Democratic Party, are all ideologically bankrupt. This explains the persistent ethnic identities of these parties, their lack of tangible policies that can be sold to Kenyans and the utter confusion known to reign supreme once these parties come to power. In the absence of ideological parties armed with clear programs, analysis of political parties in Kenya is fundamentally ethnic based, if not, tribally oriented. A dominant feature in the ethnic arrangement in Kenya’s politics is that there is a marked hatred of the Kikuyu ruling class because of bad memories and dirty histories. This perception will, no doubt, complicate the Presidential ambitions of any Kikuyu candidate in the next elections.

Three reasons why Kikuyu ruling elite is hated by millions of Kenyans
The Kikuyu ruling elite is hated by millions of Kenyans from 41 ethnic groups because of three major reasons. The first reason is “running down Kenya”. Since this elite took power in January 2003, it has plundered the country’s economy, looted the country’s Treasury disproportionately, accumulated enormous wealth through theft of public funds, violated the human rights of Kenyans with impunity, perpetuated corruption at all levels of government, entrenched tribalism especially in the appointment of top  public servants, remained totally unaccountable in matters of public policy and treated Kenya like a permanent “Kikuyu property” whose people must be ruled by a Kikuyu. Because of the excesses of the Kikuyu ruling class, being a Kikuyu has become a huge burden to millions of law abiding, poor and deprived Kikuyus equally suffering alongside millions of other Kenyans. In fact, the general hatred of the ruling Kikuyu elite is the main fuel propelling alternative non-Kikuyu Parties seeking power in Kenya. For every ethnic group, “it’s their turn to eat” because the perception is that the Kikuyu have been eating for “too long”.

The second reason why the Kikuyu ruling elite is hated in Kenya is because of what is largely perceived as sheer arrogance and lack of respect for the 41 ethnic groups that constitute the Kenyan Nation. After Jomo Kenyatta, a Kikuyu, held power for fifteen years, and after President Mwai Kibaki, another Kikuyu, has held power for 10 years (assuming he completes his final term), the most other ethnic groups expected was for the Kikuyu elite to lie low (like an envelope) especially on the question of Kenya’s fourth President. The reason is that in the last 48 years, the Kikuyu have held power for 25 years, which, according to the non-Kikuyu view, is more than enough. The situation could have been different if Kenya was driven by ideological politics because then, the ethnic origin of a President wouldn’t matter since voters would be following ideas and not individual ethnic sentiments. Instead of cooling down their heels on the question of the next President, what has the Kikuyu elite been doing?

They have been busy, setting up one political Party after another on which to seek the Presidency. In fact, a section of the Kikuyu elite are even trying to sell Uhuru Kenyatta, a suspected criminal and ICC indictee, as the next President of the Republic and this is what is driving some Kenyans to puke. The arrogance of this filthy elite is so notorious that the crimes against humanity Uhuru is facing does not matter. Uhuru is, himself, so arrogant that he has refused to resign as Deputy Prime Minister following his indictment, thereby violating the new Kenyan constitution. President Kibaki is himself so arrogant that he has refused to sack the DPM (following ICC indictment) although Uhuru is violating the very Constitution that Kibaki was so proud to promulgate in August 2010. Instead of concentrating on his defence at the ICC, Uhuru has overtly been propagating hate speeches from one “Prayer meeting” after another to fuel bitter inter-ethnic strife with the sole objective of stirring a new, bloody and genocidal civil war unrivaled in Kenya’s history before he leaves for the ICC any time soon. Because of this unspeakable arrogance, millions of Kenyans are convinced that it is time for a break with the Kikuyu ruling elite at the helm. So far, six Kikuyu candidates namely Uhuru Kenyatta, Martha Karua, Peter Kenneth, Paul Muite, Mutava Musymi and Prof George Saitoti, are vying for President. Although it is their democratic right to do so, the unfavourable anti-Kikuyu wave born out of justifiable historical circumstances and realities have not been a hindrance.

The final reason why the Kikuyu ruling elite is hated in Kenya is because this cabal is largely seen to have been responsible for the rigging of election in 2007 thereby preventing Raila Odinga from seizing power to fulfill long standing expectations of millions of voters who voted for him. It is widely believed by many Kenyans and observers alike that the Post Election Violence (PEV) could not have happened if Kibaki had handed over power to Raila. The key explanation why the Kikuyu elite stole Raila Odinga’s Presidency is because they did not believe that Raila would protect their massive and stolen wealth. These are the same fears driving the current anti-Raila campaign especially from the Kikuyu elite. In Kenya, it is called “Railaphobia”.

Is Kalenjin support for a pro-Kikuyu candidate possible?
Other forces campaigning against Raila outside Kikuyuland are not doing so primarily because of fear that Raila will not protect their stolen wealth but because of misplaced individual power ambitions. This is the ground where William Ruto and his URP, Eugine Wamalwa and his New Ford Kenya, Kalonzo Musyoka and his Wiper Party together with late comer, Musalia Mudavadi, and his newly found UDF are all camping. The big problem the non-Kikuyu anti-Raila clowns are facing is that members of their ethnic groups have equal (if not worse) hatred for the Kikuyu ruling elite. Three examples will suffice.

The Kalenjin is not an ethnic group but a conglomeration of many ethnic groups – Samburu, Turgen, Nandi, Turkana, Sabaot, Masaai et al. It is hardly plausible to argue that the Kalenjin love the Kikuyu ruling class and given the tension around land issues that has dominated the histories of these communities (with the Kikuyu being accused of having grabbed Kalenjin land), the only reason why the Kalenjin support is being associated with the G7 is because of the assumption that Ruto will actually stand as a Presidential candidate, a big illusion because Ruto will be arrested as soon as he arrives at the ICC to face crimes against humanity.

At that point, the perceived Kalenjin support for any presidential candidate from Kikuyuland will simply evaporate. This is because the Kalenjin are already arguing that they supported a Kikuyu in 2002 (Uhuru) and that a new support for a new Kikuyu presidential candidate will be “too much” expectation. In 2007, the Kalenjin were strongly advised by former President Moi to vote for Kibaki but they responded by voting for Raila and ejecting all of Moi’s children and sycophants from Parliament. To assume that the Kalenjin will follow Ruto like goats being herded into a pen is to fail to learn from recent Kalenjin history. Voting for a Kikuyu President will simply threaten Kalenjin consolidation of land they gained following the PEV and it is just a matter of time before this perspective is confirmed. This explains why despite the protracted Uhuru-Ruto dance-shows at the so-called Prayer meetings, Kikuyu IDPs are not moving an inch from the filthy camps to resettle in the Rift Valley. They are simply not welcome by the Kalenjin and this position is what will duplicate itself at the ballot. Will the Kalenjin vote for Mudavadi instead?

Mudavadi’s baggage as a Kikuyu-ruling class fall-back candidate
If Mudavadi was truly an independent minded candidate, he could have been the perfect alternative who could have scooped any anti-Raila votes in Kalenjin land.  Since he decamped from ODM to UDF, Mudavadi has quickly emerged as a Moi-Kibaki Project and a fall-back candidate of the Kikuyu ruling elite which knows and understands that Uhuru, their preferred candidate, will be locked in The Hague sooner rather than later. The profile of Mudavadi as the “Kikuyu mask” in a “Luhya skin” will deprive him of both the Kalenjin and Luhya votes from “anti-Kikuyu ruling class voters” from these communities. This is why Mudavadi is heading for political oblivion.

From the local newspapers, it is now public knowledge that UDF was set up by Kibaki’s boys for Uhuru Kenyatta before things went terribly wrong, forcing Uhuru to abandon the ill-fated Party which Mudavadi has converted into a new home. Needless to say, Mudavadi’s welcoming ceremony at KICC last week was infested with top KANU apparatchiks because Moi sent them to back his candidate. So far, KANU has no Presidential candidate and it will not be surprising if, at the next Press conference, Kenyans hear that KANU is backing Mudavadi! Nick Salat, a KANU fat cat, was introduced at Mudavadi’s UDF reception along with other medium-sized KANU lap dogs who might not even make it back to Parliament because KANU is essentially a dead Party.  Although many Luhya’s may be sympathetic to Mudavadi because of blood relations, majority of their top leaders refused to follow him to UDF, why?

Just like other ethnic groups who have suffered under the weight of the thieving Kikuyu elite, the Luhyas harbour equal and atavistic hatred for the Kikuyu ruling elite. Since Mudavadi’s strategy appears to be based on re-packaging himself as an alternative Kikuyu ruling class candidate (given the impending lock-up of Uhuru Kenyatta at The Hague), the impact of Mudavadi’s Presidential candidacy was greatly diluted.

The same problem bedevils Eugine Wamalwa whose membership in the G7 Alliance locates him in the murky pool of Kikuyu ruling class fall-back candidates. In fact, the appointment of Wamalwa as Minister for Justice to replace the highly performing Mutula Kilonzo did more harm than good to the young Eugine because the appointment reinforced his profile as a confirmed stooge of the Kikuyu ruling elite.

Hours after his appointment, he was manipulated to begin steering the Justice Ministry on anti-ICC tracks and he did his job with gusto. Eugine has been doing poorly in the opinion polls primarily because of the Kikuyu ruling class “baggage” he carries on his shoulders at every G7 rally. The inability of Eugine to realise that he is being used as the new toilet paper (following the dumping of Wetangula) adds flesh to his image as an “overgrown political baby”. When I warned Wetangula in February 2008 that he would be used and dumped by the Kikuyu elite, he did not understand despite his law degree.

With Uhuru Kenyatta and William Ruto locked behind bars at The Hague; with Martha Karua, George Saitoti, Mutava Musymi, Paul Muite and Peter Kenneth emerging as non-starters because of the “Kikuyu baggage” on their backs and lack of a national appeal; with Mudavadi’s political profile suffering under the weight of multiple corruption scandals, “Kikuyu mask in a Luhya skin” image, Johnny come lately perspective, latter day ODM traitor badge; “UDF a Moi-Kibaki Project” stamp; with Kalonzo Musyoka’s Wiper “Demographic” Party having been wiped out of the political map following the 2007 burial of Kalonzo’s political future after election rigging; and with naïve Wamalwa unable to make an impact because of being fed too much “political milk” from the hated G7 cow, who will become Kenya’s next President? Your guess could be as good as mine but do I say!

With deep appreciation, the George Obor family would like to acknowledge the many expressions of love, kindness and support which was shown to them during their hour of need following the sudden departure of George. May God bless and keep you all!  A big “Thank you” to: The George Obor Funeral Committee in Stockholm, Mr. Jared Odero, Mr. Okoth Osewe, Mr. Joshua Oyugi, Mr. Antony Odera, Mr. Jasper Orieny and Mr. Joe Goga, for their time and energy following our bereavement. I greatly appreciated your generosity and support during those very difficult times.

We would also like to thank everyone who attended and gave us their financial support during the Harambee that was held on the 24th of March. Your contribution to the Funeral Fund was the perfect remembrance to George’s giving spirit. Thank you very much for such a special Harambee that will remain in our minds for ever.

Words alone cannot express how much we thank you all for the sincere expressions of sympathy, and all the help you provided us during our moment of sadness and sorrow.  We are truly grateful for your friendship and support. Please let me express my deepest appreciation to all those who were involved, directly or indirectly, in planning the Harambee.

Much gratitude to: everybody who bankrolled the event; those who prepared the wonderful food; and all those who saw to it that the Harambee achieved its objective. You are truly good friends and relatives. A vote of thanks also goes to all those who were unable to attend the Harambee but sent their generous donations in George’s honor. Your soothing words brought comfort and hope to us at the most critical time.  We greatly appreciate the services of Pastor Britt-Marie Godman who conducted the Memorial service with humility, love and compassion. Many thanks to Sister Katherine who introduced us to the Pastor thereby enabling the truly beautiful service to be performed at the Chapel.

Please, understand that you are most appreciated and we would like to let you know that we thank you all for whatever you did for us, be it through the beautiful flowers that you sent, the consoling telephone calls that you made, the kind words that soothed our souls, the visit that you made at our home or your presence at the hospital. We very much appreciate your thoughtfulness during this difficult time.

Who is Moses Mudavadi?

Mudavadi has a history of corruption

Born in 1960, Musalia Mudavadi first entered Parliament as the MP for Sabatia Constituency on a KANU ticket in 1989 following the death of his father Moses Mudavadi. Moi had a good relationship with Musalia’s father who was largely seen as responsible for delivering the Luhya support for the Moi dictatorship. To maintain this support after the death of the senior Mudavadi, Moi appointed Musalia Minister of Supplies and Marketing. After returning to Parliament in 1992, Musalia was once again appointed a Minister, this time taking over the Ministry of Finance in January 1993, a post he led until the 1997 December elections, which Moi is accused by Raila to have rigged to return himself to power.

After this election, Musalia was appointed Minister of Agriculture in 1998, a time when he also served as Leader of Government Business in Kenya’s Parliament. He then moved to occupy the Ministry for Information, Transport and Communication in 1999 topping his political career as Vice President of Kenya and Minister for Transport and Communication in the run up to the December 2002 elections. The younger Mudavadi was bribed with the post of VP two months before the December 2002 elections and after KANU lost power, he went down in history as the Kenyan VP who sat in office for the shortest time ever. It is believed that this bribe prevented Mudavadi from crossing over to the Rainbow coalition, which later formed the government after defeating KANU. Within politicians who decided to work with Raila in ODM, Musalia was one of the most experienced in government, having worked under Moi for slightly more than a decade. But that is the better image depicting Mudavadi as the progressive politician who climbed the ladder to the top, from MP to Vice President, within a considerably short time.

During his tenure, documentation exists linking Mr. Mudavadi to a chain of corruption scandals that puts to question his credibility as a honest leader who could help change Kenya. According to the Paris-based research group — Centre d’Etudes et Recherches (CERI) — Mudavadi is one of the key politicians who was linked to two groups of Asian businessmen nicknamed the “G7” who had monopoly status of contracts in Kenya when Mudavadi was Finance minister. According to the CERI Report, which was published in April 1998, both Mudavadi and Attorney General Amos Wako (Both Luhyas from Western Province) were the Godfathers of Mr. Haten Singh Bishar who enjoyed monopoly status of contracts in Western Kenya. In government, Mudavadi worked with the well-known corruption guru in Kenya, Mr. Nicholas Kipyator arap Biwott, former Energy Minister whom, according to the CERI Report, was the Godfather of Harbinder Singh Sethi, another businessman who had monopoly status of contracts issued at that time by the Ministry of Energy.302 Mudavadi has been connected to the Anglo-Leasing type scandals that later came to haunt the Kibaki regime and that have been covered briefly in this book. The former Vice President was Minister of Transport when the fraudulent contract to procure VSAT equipment was signed in July 2002. On June 19 of the same year, Mudavadi wrote a project justification letter to the then Minister of Finance Mr. Chris Obure seeking exemption of the Postal Corporation of Kenya from the Audit and Exchequer Public Procurement Regulations of 2001 that was specifically set up to check corruption when it came to public procurements by government agencies.

In the same letter, Mudavadi went further and sought permission for the Posta Corporation to enter into direct procurement of goods and services from Universal Satspace (an American company), Spacenet Incorporated and First Mercantile Securities Corporation (both of Switzerland). The curious point is that according to the April 2006 Report from the Controller and Auditor General, the Companies in whose favour Mudavadi had written in his capacity as a Cabinet Minister did not exist. The Companies wanted to install broadband Network and VSAT equipment in 980 post offices across the country in a project baptized “Posta Surf ” at a tune of Ksh2.8 billion. The gist of Mudavadi’s intervention is that he wanted the companies awarded the contracts without any tendering as stipulated in law. In an Affidavit dated March 27, 2006, and signed by Julius Shigolia, the Secretary of the Postal Corporation of Kenya, Mudavadi’s letter “was totally unfounded, misleading and evidence of a conspiracy to defraud the Republic of Kenya.”303 Mudavadi wanted the contracts awarded to Satspace, which was not registered in Kenya and despite the fact that the same job could be done by Telkom Kenya. In his Affidavit, Shigolia claimed that a company called Gilat Alldean (Africa) had fraudulently claimed that it is the parent company of Spacenet, an American company, in order to give foreign companies a legal basis of participating in contracts in Kenya.

During the sixty-first day of the Goldenberg Inquiry headed by Justice Bosire, allegations emerged that Ksh5.8 billion was paid out “for no consideration” under the authority of Dr. Koinange between April 19, 1993, and July 6, 1993. During this period, Mudavadi was the Finance Minister and at the time of the Inquiry, it had not been established who the recipients of the money were. The money was routed through the Kenya Commercial Bank into private accounts. Although Mudavadi was never implicated directly as having been responsible, the question was how such a huge amount of money could have been transferred by his juniors and without his knowledge as Finance Minister. Corruption scandals came back to haunt Mr. Mudavadi to an extent that at one point, he was subjected to intensive grilling by the otherwise toothless Kenya Anti-Corruption Commission that was headed by Justice Aron Ringera.

After KANU was defeated, Mudavadi quit KANU to join Raila’s LDP for joint work because of the common cause of bringing the Kibaki government down. In the process of working with Raila, Mudavadi got the opportunity to shade off his dirty past and re-emerge as a new and fresh leader who could make a difference in Kenya’s democratization process.
